CHAPTER 1.<br />

INSURANCE DEPARTMENT.<br />

SECTION 5460. Appointment by governor—confirmation by senate—term—bond.<br />

1 There is hereby created and established a department to be known<br />

2 as the insurance department <strong>of</strong> <strong>Iowa</strong>. The chief <strong>of</strong>ficer <strong>of</strong> said de-<br />

3 partment shall be styled "commissioner <strong>of</strong> insurance". On or before<br />

4 the first day <strong>of</strong> February, nineteen hundred fifteen, the governor shall<br />

5 nominate, and with the consent <strong>of</strong> two-thirds <strong>of</strong> the members <strong>of</strong> the<br />

6 senate in executive session, appoint a person for commissioner, who<br />

7 shall be selected solely with regard to his qualifications and fitness to<br />

8 discharge the duties <strong>of</strong> this position. No nomination shall be con-<br />

9 sidered by the senate until the same shall have been referred to a com-<br />

10 mittee <strong>of</strong> five, not more than three <strong>of</strong> whom shall belong to the same<br />

11 political party, to be appointed by the president <strong>of</strong> the senate without<br />

12 formality <strong>of</strong> a motion, which committee shall report to the senate in<br />

13 executive session, which report shall be made at any time when called<br />

14 for by the senate. The consideration <strong>of</strong> nominations by the senate<br />

15 shall not be had on the same legislative day that the nominations are<br />

16 so referred. Subsequent appointments shall be made as above pro-<br />

17 vided and, except to fill vacancies, shall be for a period <strong>of</strong> four years.<br />

18 He shall be subject to removal only under and according to the pro-<br />

19 visions <strong>of</strong> chapter twenty-one, title four. The governor shall fill as in<br />

20 the first instance any vacancy which may arise in this <strong>of</strong>fice. Before<br />

21 entering upon the discharge <strong>of</strong> the duties <strong>of</strong> his <strong>of</strong>fice, the commis-<br />

22 sioner <strong>of</strong> insurance shall give a bond in the penal sum <strong>of</strong> twenty-<br />

23 five thousand dollars, conditioned as provided for in section six hun-<br />

24 dred twelve <strong>of</strong> the compiled code, the same to be approved by the<br />

25 executive council and filed in the <strong>of</strong>fice <strong>of</strong> the secretary <strong>of</strong> state.<br />

SEC. 5462. Deputy—bond—assistants.<br />

1 The commissioner <strong>of</strong> insurance is hereby directed to appoint a<br />

2 deputy commissioner to assist him in his work, who shall serve dur-<br />

3 ing the pleasure <strong>of</strong> the commissioner <strong>of</strong> insurance. Before entering<br />

. 4 upon the duties <strong>of</strong> his <strong>of</strong>fice, the deputy commissioner shall give a bond<br />

5 in the penal sum <strong>of</strong> ten thousand dollars conditioned as provided in<br />

6 section six hundred twelve <strong>of</strong> the compiled code, the same to be ap-<br />

7 proved by the executive council and filed with the secretary <strong>of</strong> state.<br />

8 The commissioner <strong>of</strong> insurance is also empowered and directed to<br />

9 appoint such other clerks and assistants as shall be needed in the
