CHAPTER 5.<br />

INTERURBAN RAILWAYS.<br />

SECTION 5241. Grade crossings—duties <strong>of</strong> employees—penalty.<br />

1 Wherever the tracks <strong>of</strong> an interurban railway cross the tracks<br />

2 <strong>of</strong> any steam railway at grade the steam railway shall have, except<br />

3 where required to stop by order <strong>of</strong> the board <strong>of</strong> railroad commission-<br />

4 ers, the right <strong>of</strong> way and not be compelled to stop its trains and the<br />

5 interurban railway company operating said line shall cause its cars<br />

6 to come to a full stop not nearer than ten feet nor farther than fifty<br />

7 feet from such crossing, and before proceeding to cross said steam<br />

8 railway tracks shall cause some person in its employ first to cross said<br />

9 track ahead <strong>of</strong> said car or cars and ascertain if the way is clear and<br />

10 free from danger for the passage <strong>of</strong> said interurban cars, and said<br />

11 interurban cars shall not proceed to cross until signalled to do so by<br />

12 such person employed as aforesaid, or said way is clear for such pas-<br />

13 sage over said tracks. Every person in charge <strong>of</strong> any interurban car<br />

14 or cars, who wilfully fails to comply with the provisions here<strong>of</strong> and<br />

15 fails to bring the car or cars which he has in charge to a stop, or<br />

16 causes the same to cross said steam railway tracks before the way is<br />

17 clear, or he is signalled to do so, shall be subject to a fine <strong>of</strong> not less<br />

18 than one hundred dollars nor more than two hundred dollars or im-<br />

19 prisonment in the county jail not to exceed twelve months, in the dis-<br />

20 cretion <strong>of</strong> the court. No steam railway shall obstruct the free passage<br />

21 <strong>of</strong> the cars <strong>of</strong> an intersecting interurban railway at such crossing.<br />

SEC. 5241-al. Bight <strong>of</strong> steam and interurban railways at grade<br />

crossing.<br />

1 The board <strong>of</strong> railroad commissioners <strong>of</strong> the state <strong>of</strong> <strong>Iowa</strong> is here-<br />

2 by granted jurisdiction over all crossings at grade <strong>of</strong> steam and inter-<br />

3 urban railways within the state. Upon the application <strong>of</strong> any inter-<br />

4 urban railway, or upon its own motion, the said board may require<br />

5 the trains <strong>of</strong> any steam railway to stop at any such crossing or cross-<br />

6 ings at grade, or said board may make such rules and regulations in<br />

7 reference to speed or other methods <strong>of</strong> operation at such crossings<br />

8 as in its judgment are necessary to protect the public safety. This<br />

9 section is to be construed as an exception to the general rule as laid<br />

10 down in section fifty-two hundred thirty-seven <strong>of</strong> the compiled code,<br />

11 with reference to interurbans being street railways within cities and<br />

12 towns.<br />
