CHAPTER 1.<br />

BOARD OF RAILROAD COMMISSIONERS.<br />

SECTION 5019. Duty <strong>of</strong> railroad to transport freight—passenger<br />

service.<br />

1 Every railway corporation shall upon reasonable notice, and with-<br />

2 in a reasonable time, furnish suitable cars to any and all persons who<br />

3 may apply therefor, for the transportation <strong>of</strong> any and all kinds <strong>of</strong><br />

4 freight, and receive and transport such freight with all reasonable<br />

5 dispatch, and provide and keep suitable facilities for the receiving and<br />

6 handling there<strong>of</strong> at any depot on the line <strong>of</strong> its road ; and shall also<br />

7 receive and transport in like manner the empty or loaded cars f ur-<br />

8 nished by any connecting road, to be delivered at any station or sta-<br />

9 tions on the line <strong>of</strong> its road, to be loaded or discharged or reloaded<br />

10 and returned to the road so connecting; and for compensation it shall<br />

11 not demand or receive any greater sum than is accepted by it from<br />

12 any other connecting railroad for a similar service. In any suit or<br />

13 action in court brought against a railroad corporation for the purpose<br />

14 <strong>of</strong> enforcing rights arising under the provisions <strong>of</strong> this section, the<br />

15 burden <strong>of</strong> proving" that the provisions <strong>of</strong> this section have been com-<br />

16 plied with by such railroad corporation shall be upon such railroad<br />

17 corporation. Every railway corporation owning or operating lines <strong>of</strong><br />

18 railroads <strong>of</strong> more than seventeen miles in length within the limits <strong>of</strong><br />

19 the state <strong>of</strong> <strong>Iowa</strong> shall maintain a service <strong>of</strong> not less than two pas-<br />

20 senger trains each way every twenty-four hours, over the entire length<br />

21 <strong>of</strong> each division <strong>of</strong> such line or lines, when so ordered by the board <strong>of</strong><br />

22 railroad commissioners. Passenger service <strong>of</strong> less than the number <strong>of</strong><br />

23 trains provided herein shall be presumed to be unreasonable within<br />

24 the contemplation <strong>of</strong> section fifty hundred sixteen <strong>of</strong> the compiled code.<br />
