BOARD OF RAILROAD COMMISSIONERS.
SECTION 5019. Duty of railroad to transport freight—passenger
service.
1 Every railway corporation shall upon reasonable notice, and with-
2 in a reasonable time, furnish suitable cars to any and all persons who
3 may apply therefor, for the transportation of any and all kinds of
4 freight, and receive and transport such freight with all reasonable
5 dispatch, and provide and keep suitable facilities for the receiving and
6 handling thereof at any depot on the line of its road ; and shall also
7 receive and transport in like manner the empty or loaded cars f ur-
8 nished by any connecting road, to be delivered at any station or sta-
9 tions on the line of its road, to be loaded or discharged or reloaded
10 and returned to the road so connecting; and for compensation it shall
11 not demand or receive any greater sum than is accepted by it from
12 any other connecting railroad for a similar service. In any suit or
13 action in court brought against a railroad corporation for the purpose
14 of enforcing rights arising under the provisions of this section, the
15 burden of proving" that the provisions of this section have been com-
16 plied with by such railroad corporation shall be upon such railroad
17 corporation. Every railway corporation owning or operating lines of
18 railroads of more than seventeen miles in length within the limits of
19 the state of Iowa shall maintain a service of not less than two pas-
20 senger trains each way every twenty-four hours, over the entire length
21 of each division of such line or lines, when so ordered by the board of
22 railroad commissioners. Passenger service of less than the number of
23 trains provided herein shall be presumed to be unreasonable within
24 the contemplation of section fifty hundred sixteen of the compiled code.
