SEC. 4880-al. Time bonds or proceeds available.<br />

1 The bonds issued under the provisions <strong>of</strong> the preceding section,<br />

2 or the proceeds there<strong>of</strong>, shall be available for use <strong>of</strong> the district, at a<br />

3 date not later than ninety days after the actual commencement <strong>of</strong> the<br />

4 work, as provided in sections forty-eight hundred forty-three <strong>of</strong> this<br />

5 supplement and forty-eight hundred seventy-nine <strong>of</strong> the compiled code.<br />

SEC. 4882. Supervising engineer—contractor—how paid.<br />

1 At the time <strong>of</strong> establishing the levee or drainage district the<br />

2 boards <strong>of</strong> supervisors shall appoint a competent engineer to have<br />

3 charge <strong>of</strong> the construction <strong>of</strong> the work, and they shall fix his com-<br />

4 pensation therefor, and he shall, before entering upon and taking<br />

5 charge <strong>of</strong> said work, give bond to the counties for the use and benefit<br />

6 <strong>of</strong> the levee or drainage district, approved by the boards <strong>of</strong> supervisors<br />

7 in such sum as they may direct, conditioned for the faithful discharge<br />

8 <strong>of</strong> his duties. The engineer in charge <strong>of</strong> the work shall furnish the<br />

9 contractor monthly estimates <strong>of</strong> the amount <strong>of</strong> work done on each<br />

10 section and the amount due from each county, a duplicate <strong>of</strong> which<br />

11 shall be filed with the auditor <strong>of</strong> each <strong>of</strong> the several counties. Upon<br />

12 the filing <strong>of</strong> such statement each auditor shall draw a warrant or de-<br />

13 liver to him improvement certificates, or drainage bonds, as the case<br />

14 may be, in favor <strong>of</strong> the contractor for eighty per centum <strong>of</strong> the amount<br />

15 due from his respective county. When said improvement is completed<br />

16 to the satisfaction <strong>of</strong> the engineer in charge and accepted by the boards<br />

17 <strong>of</strong> supervisors, the engineer shall certify such fact to the several county<br />

18 auditors and each county auditor shall draw a warrant in favor <strong>of</strong><br />

19 the contractor, or deliver to him improvement certificates, or drainage<br />

20 bonds, as the case may be, for the balance due from his respective<br />

21 county.<br />

SEC. 4886. Cities and towns may be included—benefits assessed<br />

—notice—objections—appeal.<br />

1 The board <strong>of</strong> supervisors shall have the same power, right and<br />

2 authority to establish a levee or drainage district that includes the<br />

3 whole or any part <strong>of</strong> any incorporated town or city, including cities<br />

4 acting under special charters, as they have to establish districts as<br />

5 hereinbefore provided, and they shall have the same power, right and<br />

6 authority with respect to the assessment <strong>of</strong> damages and benefits<br />

7 within such towns or cities as they have in other cases provided for in<br />

8 this chapter, and like notice to such city or town with respect to the<br />

9 establishment <strong>of</strong> such district and the apportionment and assessment<br />

10 <strong>of</strong> damages and benefits shall be given as is required by this chapter<br />

11 to be given to owners <strong>of</strong> property damaged or benefited by the estab-<br />

12 lishment or construction <strong>of</strong> such improvement. Whenever the streets,<br />

13 alleys, public ways or parks <strong>of</strong> any incorporated town or city, or city<br />

14 acting under special charter, so included within a levee or drainage<br />

15 district, will be beneficially affected by the construction <strong>of</strong> any im-<br />

16 provement or improvements in such district, it shall be the duty <strong>of</strong> the<br />

17 commissioners appointed to classify and assess benefits to determine<br />

18 and return in their report the amount <strong>of</strong> benefit to such streets, alleys,<br />
