§ 4880. LEVEES, DRAINS AND WATERCOURSES. Tit. XV, Ch. 2.<br />

37 drainage district, each county auditor <strong>of</strong> said counties shall cause the<br />

38 owners <strong>of</strong> the lands in his county, as shown by the transfer books in<br />

39 the auditor's <strong>of</strong>fice, and also the person in actual occupancy <strong>of</strong> said<br />

40 lots or lands, in the district recommended by the commissioners, and<br />

41 also each lienholder or incumbrancer, as shown by the county records<br />

42 in his county <strong>of</strong> any land through or abutting upon which the proposed<br />

43 improvement extends, to be notified <strong>of</strong> the time and place where the<br />

44 boards <strong>of</strong> the several counties will meet in joint session for the con-<br />

45 sideration <strong>of</strong> said petition and return. Such notice shall be the same<br />

46 and served in the same time and manner as provided in this chapter<br />

47 when the levee or drainage district is wholly within one county. When<br />

48 the boards <strong>of</strong> supervisors are <strong>of</strong> unequal number, each member <strong>of</strong> the<br />

49 board <strong>of</strong> the smallest number <strong>of</strong> members shall cast a full vote, and<br />

50 each member <strong>of</strong> any larger board shall cast such fractional part <strong>of</strong> a<br />

51 full vote as may be determined by making the smallest number <strong>of</strong><br />

52 the membership <strong>of</strong> any board the numerator and the number <strong>of</strong> the<br />

53 membership <strong>of</strong> any such larger board entitled to vote the denominator<br />

54. <strong>of</strong> such fraction, so as to equalize the voting power <strong>of</strong> each board.<br />

SEC. 4880. Assessments <strong>of</strong> costs and damages—improvement certificates—bonds.<br />

1 If the boards <strong>of</strong> supervisors, acting jointly, shall establish the<br />

2 levee or drainage district, they shall appoint a commission, one <strong>of</strong><br />

3 whom shall be selected from each county, and in addition thereto a<br />

4 competent engineer, each <strong>of</strong> whom shall have the same qualifications<br />

5 as provided where the district is wholly within one county; and said<br />

6 commission shall within twenty days go upon and view the premises<br />

7 and begin the work <strong>of</strong> classifying the same as hereinbefore provided<br />

8 where the district is wholly within one county, and in addition thereto<br />

9 shall make an equitable apportionment <strong>of</strong> the costs, expenses, costs <strong>of</strong><br />

10 construction, fees and damages assessed for the construction <strong>of</strong> such<br />

11 improvement or <strong>of</strong> the repairing or reopening the same, and make<br />

12 report there<strong>of</strong> as provided where the improvement is wholly within<br />

13 one county, except a copy <strong>of</strong> said report shall be filed with each <strong>of</strong> the<br />

14 several county auditors. Immediately upon the filing <strong>of</strong> such report<br />

15 the several county auditors, acting jointly, shall cause notice to be<br />

16 served <strong>of</strong> the time when and the place where the boards <strong>of</strong> super-<br />

17 visors will meet and consider such report, which notice shall be the<br />

18 same and served in the same time and manner, and all proceedings<br />

19 thereon shall be the same as provided where the district is wholly<br />

20 within one county, publication there<strong>of</strong> to be made in each <strong>of</strong> said<br />

21 counties, except that the objections not filed prior to the day <strong>of</strong> the<br />

22 hearing shall be filed with the boards <strong>of</strong> supervisors at the place where<br />

23 the hearing is to be held, and except after the amount to be assessed<br />

24 and levied against the several parcels or tracts <strong>of</strong> land shall have been<br />

25 apportioned and finally determined, the several boards <strong>of</strong> supervisors,<br />

26 acting separately, and within their own counties, shall proceed to levy<br />

27 and collect the taxes thus apportioned in the same manner as provided<br />

28 where the district is wholly within one county, and they may issue<br />

29 improvement certificates or may sell bonds for the full amount <strong>of</strong> the<br />

30 benefits apportioned to such county.<br />
