48 bond issued shall show expressly upon its face that it is to be paid only<br />

49 by a tax assessed, levied and collected on the lands within the district<br />

50 so designated and numbered, and for the benefit <strong>of</strong> which district such<br />

51 bond is issued ; nor shall any tax be levied or collected for the payment<br />

52 <strong>of</strong> said bond or bonds, or the interest thereon, on any property outside<br />

53 the district so numbered, designated and benefited. When the board<br />

54 <strong>of</strong> supervisors shall provide for the issuance <strong>of</strong> drainage bonds, it shall<br />

55 determine what part, if any, <strong>of</strong> the amount assessed for the benefits<br />

56 to highways shall be included in such bond issue, and such part, with<br />

57 interest, shall be paid out <strong>of</strong> the proper funds in the same yearly<br />

58 proportion and at the same times as the assessments against the lands<br />

59 <strong>of</strong> private owners.<br />

SEC. 4877. Establishment through, two or more counties—voting<br />

powers <strong>of</strong> boards <strong>of</strong> supervisors equalized.<br />

1 When the desired levee or drainage district extends into or<br />

2 through two or more counties and embraces land in two or more coun-<br />

3 ties, the petition <strong>of</strong> one or more owners <strong>of</strong> land to be affected or bene-<br />

4 fited by such improvement shall be presented to the county auditor<br />

5 <strong>of</strong> each county into or through which said levee or drainage district<br />

6 will extend, accompanied by a bond to be filed with the county auditor<br />

7 <strong>of</strong> each <strong>of</strong> the said counties at the time <strong>of</strong> filing such petition, con-<br />

8 ditioned as provided when the district is wholly within one county,<br />

9 in an amount and with sureties satisfactory to and approved by the<br />

10 board <strong>of</strong> supervisors. Upon the presentation <strong>of</strong> such petition and the<br />

11 approval <strong>of</strong> such bond, the board <strong>of</strong> supervisors <strong>of</strong> each <strong>of</strong> said coun-<br />

12 ties shall appoint a commissioner, and the commissioners <strong>of</strong> the sev-<br />

13 eral counties thus appointed shall meet within thirty days thereafter<br />

14 and appoint a competent engineer, and such commissioners and engi-<br />

15 neer shall together make a survey <strong>of</strong> the entire lands embraced in<br />

16 the district, and shall determine what improvement or improvements<br />

17 in the way <strong>of</strong> levees, drains, ditches or changing <strong>of</strong> natural water-<br />

18 courses are necessary for the reclamation <strong>of</strong> the lands described in<br />

19 the said petition ; the engineer shall make a plat <strong>of</strong> all <strong>of</strong> the lands <strong>of</strong><br />

20 said district, showing thereon the proposed improvements, the eleva-<br />

21 tions and levels <strong>of</strong> said lands, so far as he may deem necessary, and<br />

22 a pr<strong>of</strong>ile <strong>of</strong> said levee, drains, ditches or changes in any natural water-<br />

23 course and shall file a copy in the auditor's <strong>of</strong>fice <strong>of</strong> each <strong>of</strong> said<br />

24 counties, together with a full return <strong>of</strong> said commissioners and engi-<br />

25 neer explaining the situation, describing the lands, the improvements,<br />

26 what effect said improvements will have upon the lands <strong>of</strong> said dis-<br />

27 trict, the course and length <strong>of</strong> any levee, drain, ditch or change <strong>of</strong> any<br />

28 natural watercourse through each tract <strong>of</strong> land, the estimated cost <strong>of</strong><br />

29 the same, the dimensions <strong>of</strong> safd improvement, together with the<br />

30 names <strong>of</strong> the owners <strong>of</strong> all lands included within said district, as<br />

31 shown by the transfer books in the auditor's <strong>of</strong>fice, and which in their<br />

32 opinion w„ill be affected or benefited thereby, together with such other<br />

33 facts and recommendations as to them shall seem advisable, and espe-<br />

34 cially whether or not in their judgment such levee or drainage district<br />

35 should be established. Immediately upon the filing <strong>of</strong> such return,<br />

36 plat and pr<strong>of</strong>ile, if such recommends the establishment <strong>of</strong> the levee or
