SEC. 4378. Regulation <strong>of</strong> jitney busses.<br />

1 Section thirty-eight hundred fourteen-a one to thirty-eight hun-<br />

2 dred fourteen-a five, inclusive, <strong>of</strong> this supplement are applicable to<br />

3 cities acting under special charters.<br />

SEC. 4422. Other provisions as to levying taxes.<br />

1 Sections forty hundred thirty-two to forty hundred thirty-four,<br />

2 inclusive, forty hundred thirty-seven and forty-six hundred two <strong>of</strong><br />

3 the compiled code, and forty hundred thirty-six-a one, forty hundred<br />

4 thirty-six-a two, forty hundred thirty-six-a three, and forty-five hun-<br />

5 dred ninety-nine <strong>of</strong> this supplement are made applicable to cities under<br />

6 special charters, except that the words "city treasurer" or "collector"<br />

7 and "city" shall be substituted for "county auditor" or "county" wher-<br />

8 ever the same appear in said sections.<br />

SEC. 4423. Special taxes.<br />

1 They shall have power to levy annually the following taxes for<br />

2 special purposes :<br />

3 1. Grading fund. A tax not exceeding three mills on the dollar<br />

4 for a grading fund, to be used for the purpose <strong>of</strong> opening, widening,<br />

5 extending or grading any street, public ground or market place.<br />

6 2. Improvement fund. A tax not exceeding three mills on the<br />

7 dollar for the city improvement fund, to be used for the purpose <strong>of</strong><br />

8 paying the cost <strong>of</strong> the making, reconstruction and repair <strong>of</strong> any street<br />

9 improvement at the intersection <strong>of</strong> streets, and spaces opposite streets<br />

10 intersecting but not crossing, and the spaces opposite property owned<br />

11 by the city or state.<br />

12 3. Sewer fund. A tax not exceeding five mills on the dollar on<br />

13 the assessed valuation <strong>of</strong> all property therein, for the city sewer fund,<br />

14 to be used to pay the cost <strong>of</strong> making, reconstructing or repairing any<br />

15 sewer at the intersection <strong>of</strong> streets, and all spaces opposite streets<br />

16 intersecting but not crossing, and at spaces opposite property owned<br />

17 by the city or state, or to pay the whole or any part <strong>of</strong> the cost <strong>of</strong><br />

18 making, reconstructing or repairing any sewer within the limits <strong>of</strong><br />

19 such city, and for the maintenance and operation <strong>of</strong> any sewage dis-<br />

20 posai plant included in said sewer district. When the city has been<br />

21 divided into sewer districts, a tax not exceeding five mills on the tax-<br />

22 able real property in the sewer district, for the district sewer fund,<br />

23 to be used to pay, in whole or in part, the cost <strong>of</strong> the making, recon-<br />

24 struction or repair <strong>of</strong> any sewer located or laid in that particular<br />

25 district, and for the maintenance and operation <strong>of</strong> any sewage dis-<br />

26 posai plant included in said sewer districts ; provided that, on petition<br />

27 <strong>of</strong> the owners <strong>of</strong> two-thirds in value <strong>of</strong> all the taxable real estate<br />

28 within such sewer district for the construction <strong>of</strong> a sewer in such<br />

29 district, then the maximum percentage <strong>of</strong> taxes that can be levied in<br />

30 any one year shall not be limited to five mills, but shall be such per-<br />

31 centage <strong>of</strong> the valuation <strong>of</strong> such property as will produce at least one-<br />

32 tenth <strong>of</strong> the whole cost <strong>of</strong> such sewer assessable upon the real property<br />

33 in such district.
