SEC. 4297-a7. Removal <strong>of</strong> commissioners.<br />

1 The council may, by a majority vote remove any <strong>of</strong> said commis-<br />

2 sioners during their term <strong>of</strong> <strong>of</strong>fice for cause, and shall fill any vacancy<br />

3 that may occur in said commission for the unexpired term.<br />

SEC. 4297-a8. Power <strong>of</strong> council in case <strong>of</strong> no commission.<br />

1 In all cases in which no civil service commissioners are appointed<br />

2 by the council, the council shall have the same powers and exercise<br />

3 and perform all the duties devolving upon such commissioners, as<br />

4 provided for in the eleven following sections.<br />

SEC. 4297-a9. Examinations—nature—time.<br />

1 Such commission shall hold examinations for the purpose <strong>of</strong> de-<br />

2 termining the qualifications <strong>of</strong> applicants for positions in the fire and<br />

3 police departments and such other departments as the city council<br />

4 may, from time to time, by ordinance or resolution designate, which<br />

5 examinations shall be held once a year and <strong>of</strong> tener if the same becomes<br />

6 necessary and they shall be practical in their character and relate to<br />

7 such matters as will fairly test the fitness <strong>of</strong> the person examined to<br />

8 discharge the duties <strong>of</strong> the position to which he seeks to be appointed.<br />

SEC. 4297-alO. List <strong>of</strong> eligibles—ratings.<br />

1 Such commission shall, as soon as possible after the examinations<br />

2 are held, prepare a list <strong>of</strong> eligibles for each department, which lists<br />

3 shall show the ratings <strong>of</strong> each person as determined from the exam-<br />

4 ination and those persons having the highest rating shall appear first<br />

5 upon said lists. Such lists <strong>of</strong> eligibles shall be preserved by the clerk<br />

6 <strong>of</strong> the commission. New lists shall be prepared each year and ap-<br />

7 pointments made therefrom, except that the appointing <strong>of</strong>ficer may<br />

8 make appointments from names appearing upon previous lists if he<br />

9 desires to do so.<br />

SEC. 4297-all. Appointments to <strong>of</strong>fice.<br />

1 All vacancies occurring in positions under civil service shall be<br />

2 filled from the eligible lists thus prepared. When a vacancy occurs<br />

3 the city manager shall notify the clerk <strong>of</strong> the commission there<strong>of</strong>.<br />

4 Whereupon said clerk shall certify to said manager the names <strong>of</strong> three<br />

5 persons whose rating appear the highest upon the eligible list, from<br />

6 which list the manager shall fill the vacancy.<br />

SEC. 4297-al2. Dropping names from eligibility list—temporary<br />

appointments.<br />

1 No name shall be certified more than three times, and if the name<br />

2 <strong>of</strong> a person is certified three times and he is not appointed, such name<br />

3 shall be dropped from the eligible list. If the eligible list in any de-<br />

4 partment shall be reduced to less than three, then the manager may<br />

5 temporarily fill a vacancy until the next examination <strong>of</strong> the commis-
