1 Whenever by ordinance or resolution <strong>of</strong> the council the powers and<br />

2 duties heret<strong>of</strong>ore vested in any other appointive municipal <strong>of</strong>ficer are<br />

3 to be wholly performed by the said city manager, then no appointment<br />

4 <strong>of</strong> such said appointive <strong>of</strong>ficer shall be made, and any appointment <strong>of</strong><br />

5 such <strong>of</strong>ficer, made prior to the adoption <strong>of</strong> such ordinance or resolution<br />

6 shall be hereby canceled.<br />

CHAPTER 40.<br />

CITY MANAGER PLAN BY POPULAR ELECTION.<br />

NOTE: The heading <strong>of</strong> this chapter has been changed from "Government <strong>of</strong><br />

Cities and Incorporated Towns by a Council and Manager" to the above to coordinate<br />

it with the new chapter heading adopted for the preceding chapter.<br />

SECTION 4281-al. Limit <strong>of</strong> indebtedness.<br />

In any city adopting the form <strong>of</strong> government provided for in this<br />

chapter, whose indebtedness prior to the time the change in government<br />

was made was limited to five per centum <strong>of</strong> the actual value <strong>of</strong><br />

the taxable property therein, and whose actual indebtedness, at the<br />

date <strong>of</strong> such change, exceeds one and one-quarter per centum <strong>of</strong> the<br />

actual value <strong>of</strong> the taxable property <strong>of</strong> said city, the limit <strong>of</strong> indebtedness<br />

<strong>of</strong> such city shall be determined by adding to the indebtedness<br />

limit, under the general laws for cities, the actual value, as determined<br />

by the city council, <strong>of</strong> municipally owned and operated utilities, and<br />

it shall be limited to such an amount; provided, however, that the<br />

amount thus arrived at shall in no event exceed five per centum <strong>of</strong> the<br />

actual value <strong>of</strong> the taxable property in said city, as shown by the state<br />

and county tax list.<br />

SEC. 4283-al. Pensions for policemen and firemen—laws applicable.<br />

1 The law as it appears in chapters thirty-six and thirty-seven <strong>of</strong><br />

2 this title shall be applicable to and effective in cities which adopt the<br />

3 city manager plan <strong>of</strong> government under the provisions <strong>of</strong> this chapter.<br />

SEC. 4297-al. Civil service commission—laws applicable.<br />

1 The law as it appears in section forty-two hundred thirty-two<br />

2 <strong>of</strong> the compiled code shall be applicable to and effective in any city<br />

3 which may hereafter adopt the city manager plan <strong>of</strong> government under<br />

4 the provisions <strong>of</strong> this chapter, provided that all powers and duties
