SEC. 4265. Tax for garbage disposal plant.<br />

1 The council <strong>of</strong> any city having a population <strong>of</strong> seventy thousand<br />

2 or more, organized under this chapter, shall have the power to levy a<br />

3 tax upon all taxable property in said city not to exceed one mill on the<br />

4 dollar each year for the purpose <strong>of</strong> acquiring a location for and equip-<br />

5 ment, maintenance and construction <strong>of</strong> a garbage disposal plant or<br />

6 system, but nothing in this section or sections forty-two hundred<br />

7 sixty-six, forty-two hundred sixty-seven and forty-two hundred sixty-<br />

8 eight <strong>of</strong> the compiled code shall be held to extend the powers <strong>of</strong> such<br />

9 cities to make annual levies for general and special taxes in excess <strong>of</strong><br />

10 forty-eight mills on the dollar <strong>of</strong> the taxable value <strong>of</strong> the property<br />

11 therein.<br />

CITY MANAGER PLAN BY ORDINANCE.<br />

NOTE: This chapter appeared in the compiled code as chapter 3 <strong>of</strong> this title.<br />

It is reprinted in this supplement as chapter 39-A <strong>of</strong> title XIII so that it will precede<br />

the chapter on '^City Manager Plan by Popular Election" in the permanent<br />

code. The change in the heading <strong>of</strong> the chapter from "Municipal Managers" to<br />

the above has been made in order to coordinate it with the new chapter heading<br />

adopted for Çhe following chapter.<br />

SECTION 4271-al. City manager—duties and compensation.<br />

1 All cities and towns, except cities under the commission form <strong>of</strong><br />

2 government and cities having a population <strong>of</strong> more than twenty-five<br />

3 thousand as shown by the last preceding census, are hereby authorized<br />

4 to provide by ordinance for the creation <strong>of</strong> the <strong>of</strong>fice <strong>of</strong> city manager<br />

5 and to fix likewise the duties and powers and compensation <strong>of</strong> such<br />

6 <strong>of</strong>ficer.<br />

SEC. 4271-a3. Duties which may be imposed.<br />

1 Said city and town after having selected or appointed such city<br />

2 manager may by ordinance provide that the city manager shall per-<br />

3 form any or all <strong>of</strong> the duties incumbent upon the street commissioner,<br />

4 or manager <strong>of</strong> public utilities, cemetery sexton, city clerk and super-<br />

5 intendent <strong>of</strong> markets, and that he shall superintend and inspect all<br />

6 improvements and work upon the streets, alleys, sewers, and public<br />

7 grounds <strong>of</strong> the city or town, and to perform such other and further<br />

8 duties as may be imposed upon him, and to possess such other and<br />
