ment, wherein the census enumerators have completed taking the<br />

census, reported the same to the county auditor, and the county auditor<br />

has made a return <strong>of</strong> the same to the executive council, such<br />

return showing such city to have a population <strong>of</strong> fifteen thousand<br />

or more, the city council <strong>of</strong> such city may immediately appoint a police<br />

judge the same as though the executive council had completed the<br />

canvass <strong>of</strong> the census and certified the same as <strong>of</strong>ficial. All cities <strong>of</strong><br />

the second class appointing police judges as herein provided shall<br />

within two years after the <strong>of</strong>ficial census returns are published abolish<br />

such police court, unless such city completes all necessary steps to<br />

become a city <strong>of</strong> the first class as provided by law. In cities <strong>of</strong> the<br />

second class not having a superior court the mayor shall hold police<br />

court, as now provided by law. Any <strong>of</strong>ficer or assistant elected or<br />

appointed by the council may be removed from <strong>of</strong>fice at any time by<br />

vote <strong>of</strong> a majority <strong>of</strong> the members <strong>of</strong> the council, except as otherwise<br />

provided for in this chapter.<br />

SEC. 4241. Street improvements and sewers in certain cities.<br />

Cities under the commission plan having a population <strong>of</strong> more<br />

than twenty thousand, and in which is situated no city cemetery, but<br />

contain within their confines a cemetery established for more than<br />

twenty years, and is conducted by a cemetery association or corporation<br />

operated not for pecuniary pr<strong>of</strong>it, and which cemetery contains<br />

more than forty acres and is so situated as to for a distance <strong>of</strong> more<br />

than fifteen hundred feet bar access to the city, which cemetery has<br />

a frontage <strong>of</strong> more than fifteen hundred feet upon one <strong>of</strong> the main<br />

traveled streets or highways leading into said city, and upon which<br />

street or highway a street car track is laid, and which street or highway<br />

is so situated as to make it impracticable to levy special assessments<br />

against a large portion <strong>of</strong> the abutting property so situated,<br />

are hereby authorized to avail themselves <strong>of</strong> the provisions <strong>of</strong> sections<br />

thirty-nine hundred twelve, thirty-nine hundred thirteen, thirty-nine<br />

hundred fourteen, thirty-nine hundred fifteen, thirty-nine hundred<br />

seventeen, thirty-nine hundred eighteen, thirty-nine hundred nineteen<br />

<strong>of</strong> this supplement and thirty-nine hundred sixteen, thirty-nine hundred<br />

twenty, thirty-nine hundred twenty-one and thirty-nine hundred<br />

twenty-two <strong>of</strong> the compiled code, for the purpose <strong>of</strong> building, repairing<br />

and paying for sewer under and curbing and pavement along and upon<br />

said street or highway in front <strong>of</strong> such cemetery ; and for the proportion<br />

<strong>of</strong> the cost there<strong>of</strong> not properly assessable against such street car<br />

line and not justly assessable against abutting property other than<br />

that owned by the cemetery association, in addition to all other levies<br />

now authorized by law, may, in lieu <strong>of</strong> the provisions <strong>of</strong> section thirtynine<br />

hundred nineteen <strong>of</strong> this supplement, levy an annual tax not exceeding<br />

one mill upon all taxable property excepting moneys and credits<br />

contained in said city, or any principal division or district there<strong>of</strong><br />

as may be determined or established by the city council. The tax<br />

herein provided for may be accumulated from year to year until such<br />

special fund is sufficient for the purposes herein authorized. And such<br />

city may anticipate the collection <strong>of</strong> such tax under the provisions <strong>of</strong><br />

section thirty-nine hundred twenty <strong>of</strong> the compiled code.<br />
