204 elections in such city, the election precinct, voting places, method <strong>of</strong><br />

205 conducting election, canvassing the vote and announcing the results<br />

206 shall be the same as by law provided for election <strong>of</strong> <strong>of</strong>ficers in such<br />

207 cities, so far as the same are applicable and not inconsistent with the<br />

208 provisions <strong>of</strong> this chapter.<br />

SEC. 4219-al. Arrangement <strong>of</strong> names on ballot.<br />

1 The names <strong>of</strong> the candidates for <strong>of</strong>fices to be filled under the pre-<br />

2 ceding section shall be arranged and printed upon the primary election<br />

3 ballots and upon the general municipal election ballots in the following<br />

4 manner, to wit : The city clerk shall prepare a list <strong>of</strong> the election pre-<br />

5 cincts <strong>of</strong> his city, by arranging the various wards or precincts <strong>of</strong> such<br />

6 city in numerical order. He shall then arrange the surnames <strong>of</strong> all<br />

7 candidates for such <strong>of</strong>fices alphabetically for the respective <strong>of</strong>fices for<br />

8 the first precinct in the list; thereafter, for each succeeding precinct,<br />

9 the name or names appearing first for the respective <strong>of</strong>fices in the last<br />

10 precinct should be placed last, so that the names that were second bell<br />

fore the change be first after the change.<br />

SEC. 4S19-a2. Act declared optional—submission to electors.<br />

1 This act [39 G. A., ch, 109] shall not apply to cities now operating<br />

2 under the commission form <strong>of</strong> government heret<strong>of</strong>ore adopted and<br />

3 approved by a vote <strong>of</strong> their electors, unless the same shall have been<br />

4 submitted to a vote <strong>of</strong> the electors <strong>of</strong> said city in the manner provided<br />

5 by title five, chapter fourteen-C <strong>of</strong> the supplement to the code, 1913,<br />

NOTE: The above section apparently preserves section 4219 <strong>of</strong> the compiled<br />

code, as it was before the enactment <strong>of</strong> 39 G. A., ch. 109, for every commission<br />

governed city organized prior to said enactment which does not adopt the new<br />

plan provided in said chapter, notwithstanding the flat repeal <strong>of</strong> practically all <strong>of</strong><br />

said section 4219 and the enactment <strong>of</strong> a substitute for the repealed matter. The<br />

word "act" and the reference to the supplement to the code, 1913, have been<br />

retained because <strong>of</strong> the peculiar character <strong>of</strong> the above section.<br />

SEC. 4224. Department superintendents—<strong>of</strong>ficers and assistants.<br />

1 The mayor shall be superintendent <strong>of</strong> the department <strong>of</strong> public<br />

2 affairs and each councilman shall be superintendent <strong>of</strong> the particular<br />

3 department to which he was elected. The council shall, at the first<br />

4 regular meeting after election, or as soon as practicable thereafter,<br />

5 elect by majority vote the following <strong>of</strong>ficers : city clerk, solicitor, as-<br />

6 sessor, treasurer, auditor, civil engineer, city physician, marshal, mar-<br />

7 ket master, street commissioner, and such other <strong>of</strong>ficers and assistants<br />

8 as shall be provided for by ordinance and necessary to the proper and<br />

9 efficient conduct <strong>of</strong> the affairs <strong>of</strong> the city ; provided, however, that in<br />

10 cities having a population <strong>of</strong> less than twenty-five thousand such only<br />

11 <strong>of</strong> the above named <strong>of</strong>ficers shall be appointed as may, in the judgment<br />

12 <strong>of</strong> the mayor and councilmen, be-necessary for the proper and efficient<br />

13 transaction <strong>of</strong> the affairs <strong>of</strong> the city. In those cities <strong>of</strong> the first class<br />

14 not having a superior court, the council shall appoint a police judge<br />

15 or in any city <strong>of</strong> the second class under the commission form <strong>of</strong> govern-<br />
