4 parts or parcels there<strong>of</strong> can not, in the judgment <strong>of</strong> the county auditor,<br />

5 be made sufficiently certain and accurate for the purposes <strong>of</strong> assess-<br />

6 ment and taxation without noting the metes and bounds <strong>of</strong> the same,<br />

7 he shall cause to be made and recorded in his <strong>of</strong>fice and the <strong>of</strong>fice <strong>of</strong><br />

8 the county recorder a plat <strong>of</strong> such tract or lot with its several sub-<br />

9 divisions, including and replatting in such plat such other plats or parts<br />

10 there<strong>of</strong> included within the same lot or congressional subdivision <strong>of</strong><br />

11 land as may seem to him to be required in accordance with the pro-,<br />

12 visions <strong>of</strong> this chapter, proceeding as directed in section forty hun-<br />

13 dred seventy-nine <strong>of</strong> the compiled code, and all <strong>of</strong> its provisions shall<br />

14 govern.<br />

15 The owners <strong>of</strong> said land shall have the same right <strong>of</strong> appeal to<br />

16 the board <strong>of</strong> supervisors as is provided in section forty hundred<br />

17 eighty-one <strong>of</strong> the compiled code in the case <strong>of</strong> warranty deeds, and<br />

18 under the same conditions as to notice and hearing, provided, however,<br />

19 that parties aggrieved shall have sixty days within which to appeal.<br />

CHAPTER 36.<br />

PENSIONS FOR DISABLED AND RETIRED FIREMEN.<br />

SECTION 4093. Who entitled to pensions—conditions <strong>of</strong> retirement—amount<br />

paid—disability—exemption.<br />

1 Any member <strong>of</strong> an organized paid fire department within the pro-<br />

2 visions <strong>of</strong> this chapter who shall have served twenty-two years or<br />

3 more in such department and shall have reached the age <strong>of</strong> fifty years,<br />

4 or who shall, while a member <strong>of</strong> such department, become mentally<br />

5 or physically permanently disabled from performing the duties <strong>of</strong> a<br />

6 fireman, shall be entitled to be retired, and upon retirement he shall<br />

7 be paid out <strong>of</strong> the firemen's pension fund <strong>of</strong> the city in which such<br />

8 department is located, a monthly pension equal to one-half the amount<br />

9 <strong>of</strong> salary received by him monthly at the date he actually retires from<br />

10 said fire department. Provided, however, that no member who has<br />

11 not served five years or more in such department shall be entitled to<br />

12 be retired and paid a pension under the provisions <strong>of</strong> this chapter on<br />

13 account <strong>of</strong> being mentally or physically permanently disabled, unless<br />

14 such disability was contracted while engaged in the performance <strong>of</strong><br />

15 his duties or by reason <strong>of</strong> following the occupation <strong>of</strong> such fireman.<br />

16 Provided, further, that the chief <strong>of</strong>ficer <strong>of</strong> any fire department shall<br />

17 have the power to assign any member <strong>of</strong> the department, retired or<br />

18 drawing pensions under this chapter, to the performance <strong>of</strong> light<br />

19 duties in such fire department. The question <strong>of</strong> disability shall be<br />

20 determined by the trustees upon the advice <strong>of</strong> a physician appointed<br />

21 by the board <strong>of</strong> trustees for that purpose. Upon the death <strong>of</strong> any<br />

22 member <strong>of</strong> such fire department while in the service, or <strong>of</strong> any mem-<br />

23 ber who shall have been retired, leaving a widow or minor children<br />

24 or dependent father or mother surviving him, there shall be paid out<br />

25 <strong>of</strong> said fund as follows : To the surviving widow, so long as she re-<br />

26 mains unmarried and <strong>of</strong> good moral character, a pension <strong>of</strong> thirty<br />

27 dollars per month. If there be no surviving widow, or upon the death<br />
