SEC. 3889. Levy <strong>of</strong> assessment—installments.<br />

1 The special assessments made in said plat and schedule, as cor-<br />

2 rected and approved, shall be levied at one time, by ordinance or reso-<br />

8 lution, against the property abutting on such street improvement _or<br />

4 sewer, and, in case <strong>of</strong> sewers, upon adjacent property, and, when levied<br />

5 and certified, shall be payable at the <strong>of</strong>fice <strong>of</strong> the county treasurer.<br />

6 If the owner <strong>of</strong> any lot or parcel <strong>of</strong> land or railway or street railway,<br />

7 the assessment against which is embraced in any bond or certificate<br />

8 provided for in chapter twenty-six, title thirteen, shall, within thirty<br />

9 days from the date <strong>of</strong> such assessment, promise and agree in writing,<br />

10 indorsed on such bond or certificate, or in a separate agreement, that,<br />

11 in consideration <strong>of</strong> having the right to pay his assessment in install-<br />

12 ments, he will not make any objection <strong>of</strong> illegality or irregularity as<br />

13 to the assessment or levy <strong>of</strong> such tax upon and against his property,<br />

14 and will pay said assessment with interest thereon at such rate, not<br />

15 exceeding six per cent per annum, as shall by ordinance or resolution<br />

16 <strong>of</strong> the council be prescribed, such tax so levied against the lot or<br />

17 parcel <strong>of</strong> land or railway or street railway <strong>of</strong> such owner shall be<br />

18 payable in ten equal installments, the first <strong>of</strong> which, with interest on<br />

19 the whole assessment from date <strong>of</strong> acceptance <strong>of</strong> the work by the city<br />

20 council, shall mature and be payable on the date <strong>of</strong> such assessment,<br />

21 and the others, with interest on the whole amount unpaid, annually<br />

22 thereafter, at the same time and in the same mariner as the March<br />

23 semiannual payment <strong>of</strong> ordinary taxes; but where no such promise<br />

24 and agreement in writing shall be made by the owner <strong>of</strong> any lot or<br />

25 parcel <strong>of</strong> land or railway or street railway within said time, then the<br />

26 whole <strong>of</strong> said special assessment so levied upon and against the prop-<br />

27 erty <strong>of</strong> such owner shall mature at one time, and be due and payable,<br />

28 with interest from the date <strong>of</strong> acceptance <strong>of</strong> the work by the city<br />

29 council, on the date <strong>of</strong> such assessment, and shall be collected at the<br />

30 next succeeding March semiannual payment <strong>of</strong> ordinary taxes. All<br />

31 such taxes with interest shall become delinquent on the first day <strong>of</strong><br />

32 March next after their maturity, and shall bear the same interest,<br />

33 with the same penalties, as ordinary taxes.<br />

SEC. 3912. Paving or graveling highways leading into cities.<br />

1 Cities having a population <strong>of</strong> two thousand or more, shall have<br />

2 power to construct paved or graveled roadways along such streets,<br />

3 avenues or highways within said cities as, in the judgment <strong>of</strong> the city<br />

4 councils there<strong>of</strong>, constitute main traveled ways into and out <strong>of</strong> such<br />

5 cities, and to repair, improve and reconstruct the same, all as herein-<br />

6 after provided.<br />

SEC. 3913. Paving districts—assessments—limitation.<br />

1 Such cities shall have power to establish districts to embrace such<br />

2 portions <strong>of</strong> said cities as, in the judgment <strong>of</strong> the city councils there<strong>of</strong>.<br />

3 will receive special benefits from the construction, repair, improve-<br />

4 ment, or reconstruction <strong>of</strong> such paved or graveled roadways, to change<br />

5 the boundaries <strong>of</strong> same from time to time as may become in the judg-<br />

6 ment <strong>of</strong> such councils, just and equitable and to assess so much <strong>of</strong> the<br />

7 cost <strong>of</strong> such paved or graveled roadways against all lots or tracts <strong>of</strong>
