11 be paid from the general fund, or from the highway or poll taxes <strong>of</strong><br />

12 such cities or towns, or partly from each <strong>of</strong> such funds, or by assess-<br />

13 ing all or any portion <strong>of</strong> the cost there<strong>of</strong> on abutting and adjacent<br />

14 property according to the benefits derived from such extension, re-<br />

15 pairs and improvements as provided in chapter twenty-three, title<br />

16 thirteen.<br />

17 Provided, however, that the city council may extend the assess-<br />

18 ments made over a period <strong>of</strong> not to exceed twenty years payable in<br />

19 equal annual installments, and that such city council shall have the<br />

20 power to issue certificates or bonds in anticipation <strong>of</strong> such assessments<br />

21 and levies.<br />

22 The district benefited and in which adjacent property is to be<br />

23 assessed shall be designated and determined by the council in the<br />

24 ordinance or resolution ordering such extension, repairs and improve-<br />

25 ments, provided that nothing in this section shall be construed as<br />

26 changing the manner <strong>of</strong> assessing abutting and adjacent property<br />

27 for the cost <strong>of</strong> paving, guttering, curbing or macadamizing streets<br />

28 and alleys.<br />

SEC. 3814. Regulation <strong>of</strong> jitney busses.<br />

[Repealed by 39 G. A., ch. 115, and the five following sections enacted<br />

in lieu there<strong>of</strong>.]<br />

SEC. 3814-al. Jitney busses—regulation and license.<br />

1 Cities and towns, including cities acting under the commission<br />

2 form <strong>of</strong> government, and cities acting under the city manager plan<br />

3 <strong>of</strong> government, shall have power, under the restrictions and conditions<br />

4 hereinafter named, to regulate and license so called jitney busses and<br />

5 all motor vehicles operating upon the streets and avenues <strong>of</strong> such cities<br />

6' and towns and engaged in carrying passengers for hire on a plan sim-<br />

7 ilar to that followed by street railway companies ; to require such vehi-<br />

8 cles to be operated over reasonable routes and upon reasonable<br />

9 schedules; to impose penalties within the limits <strong>of</strong> section thirty-five<br />

10 hundred seventy-four <strong>of</strong> the compiled code, for the violation <strong>of</strong> any<br />

11 ordinance enacted hereunder, not inconsistent and in conflict with this<br />

12 and the four following sections.<br />

SEC. 3814-a2. Excluding jitneys from certain streets.<br />

1 The city or town council may prohibit any such jitney bus or<br />

2 motor vehicle from operating on that part <strong>of</strong> any such street or avenue<br />

3 on which there is operated a street car line or lines when such street<br />

4 car line is maintained and operated under a franchise granted by any<br />

5 such city or town.<br />

6 Such jitney or motor bus may cross such street or avenue at right<br />

7 angles with said street car line or lines, and in addition thereto, said<br />

8 jitney or motor busses may travel over such streets and avenues so<br />

9 far only as is necessary to cross bridges.<br />

10 Said busses and vehicles may have a terminus in the business dis-<br />

11 trict <strong>of</strong> such city or town, and for the purpose <strong>of</strong> going to and from
