CHAPTER 5.<br />

COUNTY RECORDER.<br />

SECTION 3187. Fees to be reported and paid to county—compensation.<br />

1 The recorder shall report quarterly, under oath, to the board <strong>of</strong><br />

2 supervisors, on blanks furnished by the auditor, all fees collected by<br />

3 him, and certify under oath that he has collected all fees for recording<br />

4 instruments provided by law; shall pay quarterly into the county<br />

5 treasury all fees received by him, and make annual settlement with<br />

6 the board <strong>of</strong> supervisors on the first Monday <strong>of</strong> January <strong>of</strong> each year.<br />

7 Each county recorder shall receive for his services the following com-<br />

8 pensation : In counties having a population <strong>of</strong> less than fifteen thou-<br />

9 sand, sixteen hundred dollars ; in counties having a population <strong>of</strong> fifteen<br />

10 thousand and less than twenty thousand, seventeen hundred dol-<br />

11 lars; in counties having a population <strong>of</strong> twenty thousand and less<br />

12 than twenty-five thousand, eighteen hundred dollars ; in counties hav-<br />

13 ing a population <strong>of</strong> twenty-five thousand and less than thirty thousand,<br />

14 nineteen hundred dollars; in counties having a population <strong>of</strong> thirty<br />

15 thousand and less than thirty-five thousand, two thousand dollars ; in<br />

16 counties having a population <strong>of</strong> thirty-five thousand and less than forty<br />

17 thousand, twenty-one hundred dollars; in counties having a popula-<br />

18 tion <strong>of</strong> forty thousand and less than fifty thousand, twenty-two hun-<br />

19 dred dollars; in counties having a population <strong>of</strong> fifty thousand and<br />

20 less than sixty thousand, twenty-three hundred dollars; in counties<br />

21 having a population <strong>of</strong> sixty thousand and less than seventy thousand,<br />

22 twenty-four hundred dollars; in counties having a population <strong>of</strong> sev-<br />

23 enty thousand and less than ninety thousand, twenty-five hundred dol-<br />

24 lars; in counties having a population <strong>of</strong> ninety thousand and over,<br />

25 thirty-one hundred dollars. In counties where a recorder's <strong>of</strong>fice is<br />

26 kept in two different places the county recorder shall receive five hun-<br />

27 dred dollars in addition to the compensation as fixed by the above<br />

28 schedule in this section. Any increase in salaries provided for in<br />

29 this act [38 G. A., ch. 293] shall not apply after June thirtieth, nine-<br />

30 teen hundred twenty-three.<br />

SEC 3188. Deputy recorders.<br />

1 Each county recorder may, in writing, with the consent <strong>of</strong> the<br />

2 board <strong>of</strong> supervisors, appoint one or more deputies not holding a county<br />

3 <strong>of</strong>fice, for whose acts he shall be responsible and from whom he shall<br />

4 require a bond, which bond shall be approved by the <strong>of</strong>ficer who has<br />

5 the approval <strong>of</strong> the principal's bond.. Such appointment may be re-<br />

6 voked in writing, such appointment and revocation shall be filed and<br />

7 kept in the auditor's <strong>of</strong>fice. The person or persons thus bonded shall<br />

8 qualify by taking the same oath as his principal, indorsed upon the<br />

9 certificate <strong>of</strong> appointment. The deputy, in the absence or disability<br />

10 <strong>of</strong> his principal, may perform all the duties <strong>of</strong> the principal pertaining<br />

11 to his <strong>of</strong>fice. He shall receive a salary <strong>of</strong> not less than fifty per cent<br />

12 <strong>of</strong> that <strong>of</strong> his principal, nor more than fifteen hundred dollars per<br />

13 year, to be fixed by the board <strong>of</strong> supervisors, and in case additional
