Tit. XI, Ch. 17. MOTOR VEHICLES. §§ 3079-3080.<br />

SEC. 3079. Record by owner <strong>of</strong> garage—alteration <strong>of</strong> engine number.<br />

1 It is hereby made the duty <strong>of</strong> each and every person, firm, asso-<br />

2 ciation, corporation, copartnership operating a public garage in this<br />

3 state to keep for public inspection a record <strong>of</strong> the license number and<br />

4 engine or factory serial number <strong>of</strong> all motor vehicles taken in or held<br />

5 in charge by said garage for the purpose <strong>of</strong> selling, rental, livery,<br />

6 storage or repair.<br />

7 Said record shall be filled out and signed personally by the owner<br />

8 or driver <strong>of</strong> the motor vehicle taking such vehicle to the garage and if<br />

9 signed by other than the owner, then the owner's name must be signed<br />

10 first followed by the name <strong>of</strong> the driver, and shall contain the name<br />

11 and address <strong>of</strong> the owner <strong>of</strong> the motor vehicle, the name and address<br />

12 <strong>of</strong> the person delivering or taking the motor vehicle to the garage, and<br />

13 the license number and the engine number there<strong>of</strong> and records shall<br />

14 be verified by the operator <strong>of</strong> the garage.<br />

15 The alteration or obliteration <strong>of</strong> said engine number shall be<br />

16 prima facie evidence <strong>of</strong> larceny <strong>of</strong> said motor vehicle, and the pro-<br />

17 prietor, agents, servants or employees, immediately upon the discovery<br />

18 <strong>of</strong> such obliteration or alteration, shall notify the sheriff and police<br />

19 <strong>of</strong>ficers <strong>of</strong> the proper county, and shall hold the said motor vehicle for<br />

20 a period <strong>of</strong> twenty-four hours or until investigation shall have been<br />

21 made by the sheriff or police <strong>of</strong>ficers. Provided, such record need not<br />

22 be made when a motor vehicle is taken in or held in charge a second<br />

23 time, when the owner or driver is personally known to the proprietor<br />

24 <strong>of</strong> such garage, his agent or employee.<br />

25 Any person, firm, association, corporation or copartnership found<br />

26 guilty, personally or by agent, <strong>of</strong> violating any <strong>of</strong> the provisions <strong>of</strong><br />

27 this section shall be fined in a sum not to exceed one hundred dollars.<br />

SEC. 3080. Publication <strong>of</strong> law—department rules.<br />

1 The department shall issue this chapter in pamphlet form,<br />

2 together with such rules, instruction and explanatory matter as may<br />

3 seem advisable. Copies <strong>of</strong> such pamphlet shall be given as wide dis-<br />

4 tribution as the department shall determine and a supply shall be<br />

5 furnished each county treasurer.<br />

6 The department shall have full authority to make such rules and<br />

7 issue such instructions as may be necessary to insure and obtain uni-<br />

8 formity in the administration and full enforcement <strong>of</strong> the provisions<br />

9 <strong>of</strong> this chapter. All local <strong>of</strong>ficials charged with the administration and<br />

10 enforcement <strong>of</strong> this chapter shall act and be governed in their <strong>of</strong>ficial<br />

11 acts herein required by the rules promulgated by the department.<br />
