19 ment for a term <strong>of</strong> not less than one year and not more than five years,<br />

20 or by a fine not exceeding one thousand dollars.<br />

21 A conviction <strong>of</strong> a violation <strong>of</strong> this section shall be reported forth-<br />

22 with by the trial court or the clerk there<strong>of</strong>, to the department, who<br />

23 shall, upon recommendation <strong>of</strong> the trial court, suspend the certificate<br />

24 <strong>of</strong> registration <strong>of</strong> the motor vehicle operated by the person violating<br />

25 this section, or if he be an owner, the certificate <strong>of</strong> registration <strong>of</strong> his<br />

26 motor vehicle ; and if no appeal therefrom is taken, or if an appeal duly<br />

27 taken be dismissed or the judgment affirmed, and upon notice there<strong>of</strong><br />

28 by said clerk, the department shall revoke the certificate <strong>of</strong> registra-<br />

29 tion <strong>of</strong> said motor vehicle, and shall order the certificate <strong>of</strong> registration<br />

30 delivered to the department, and shall not reissue said certificate <strong>of</strong><br />

31 registration or any other certificate <strong>of</strong> registration to such person<br />

32 unless the department, in its discretion, after an investigation, or<br />

33 upon rehearing, decides to reissue or issue a certificate.<br />

SEC. 3078. Disposition <strong>of</strong> funds.<br />

1 Ninety-four per cent <strong>of</strong> all moneys collected pursuant to the pro-<br />

2 visions <strong>of</strong> this chapter, except as otherwise provided by law and sec-<br />

3 tion thirty hundred eighty-one <strong>of</strong> the compiled code, shall be credited<br />

4 to the primary road fund by the treasurer <strong>of</strong> state and shall be appor-<br />

5 tioned among the several counties in the same ratio that the area <strong>of</strong><br />

6 each county bears to the total area <strong>of</strong> the state, said apportionment to<br />

7 be made by the state highway commission.<br />

8 Two and one-half per cent <strong>of</strong> all moneys collected pursuant to the<br />

9 provisions <strong>of</strong> this chapter, shall be set aside and shall constitute a main-<br />

10 tenance fund for the state highway commission.<br />

11 Three and one-half per cent <strong>of</strong> all <strong>of</strong> said money collected pur-<br />

12 suant to the provisions <strong>of</strong> this chapter shall constitute a fund for the<br />

13 payment <strong>of</strong> salaries as provided by law for the motor vehicle depart-<br />

14 ment, the expenses for plates, certificate containers, blanks, etc., and<br />

15 maintenance <strong>of</strong> the automobile department.<br />

16 The maintenance fund for said state highway commission shall<br />

17 be drawn out only on warrants drawn by the auditor <strong>of</strong> state on item-<br />

18 ized vouchers approved by the state highway commission, the expendi-<br />

19 tures <strong>of</strong> which commission shall be audited by the state board <strong>of</strong> audit,<br />

20 and a full and complete report <strong>of</strong> all said expenditures shall be pub-<br />

21 lished in the annual report under the chapter creating the highway<br />

22 commission.<br />

23 Biennially, at the close <strong>of</strong> the calendar year, any unexpended bal-<br />

24 anees remaining in the funds provided for the maintenance <strong>of</strong> the<br />

25 state highway department and the motor vehicle department which<br />

26 have accrued from the motor license fees paid in for that period, shall<br />

27 be apportioned among the several counties in the same manner as the<br />

28 ninety-four per cent <strong>of</strong> said funds is apportioned.<br />
