§ 2914. PRIMARY AND SECONDARY ROAD SYSTEMS. Tit. XI, Ch. 7<br />

4 1. It may elect to complete the grading, construction <strong>of</strong> bridges<br />

5' and culverts, and drainage <strong>of</strong> any part or all <strong>of</strong> the primary roads<br />

6 within the county before laying any hard surfacing.<br />

7 2. It may hard surface in any one year, such portion <strong>of</strong> the roads<br />

8 in the primary system in its county as may be met by its allotted por-<br />

9 tion <strong>of</strong> the primary road fund for said year, plus any balance remain-<br />

10 ing to its credit from previous allotments, plus the special assessments<br />

11 on abutting and adjacent real estate as hereinafter provided; or it<br />

12 may proceed in any one year with draining and grading on one or<br />

13 more divisions <strong>of</strong> the primary system and with hard surfacing on<br />

14 other divisions <strong>of</strong> said system.<br />

15 3. It may proceed with said hard surfacing in a more rapid man-<br />

16 ner when authorized to do so by the voters <strong>of</strong> the county as herein-<br />

17 after set forth, provided no hard surfacing shall be constructed on<br />

18 any division <strong>of</strong> the primary roads until the drainage and grading <strong>of</strong><br />

19 said division shall have been fully completed.<br />

20 It is hereby made the duty <strong>of</strong> the board <strong>of</strong> supervisors to pro-<br />

21 ceed in the improvement <strong>of</strong> primary roads under this chapter as fast<br />

22 as the primary road fund is available, until the improvement <strong>of</strong> the<br />

23 primary system is completed; provided, that any county, after drain-<br />

24 ing and grading its primary system, or any division there<strong>of</strong>, shall have<br />

25 the right to surface same with gravel or oil or both if by resolution<br />

26 <strong>of</strong> the board <strong>of</strong> supervisors it elects so to do. Such graveling or oiling<br />

27 shall not be considered hard surfacing within the meaning <strong>of</strong> this<br />

28 chapter. Said surfacing shall be done in accordance with the plans<br />

29 and specifications <strong>of</strong> the highway commission applicable to such<br />

30 improvement and the cost <strong>of</strong> such improvement when so done may be<br />

31 paid from the primary road fund. Vouchers therefor must be ap-<br />

32 proved by the board <strong>of</strong> supervisors and forwarded to the highway com-<br />

33 mission for final audit, approval, and payment as provided in section<br />

34 twenty-nine hundred twenty-one <strong>of</strong> the compiled code.<br />

35 The board <strong>of</strong> supervisors shall not proceed with hard surfacing<br />

36 <strong>of</strong> roads until such work shall be authorized by a majority vote <strong>of</strong> the<br />

37 electors <strong>of</strong> such county at a general election, or a special election,<br />

38 called for that purpose ; and the board <strong>of</strong> supervisors <strong>of</strong> any county<br />

39 may, on its own motion, and shall, if petitioned by the voters in any<br />

40 county equal to ten per cent <strong>of</strong> the number voting at the last general<br />

41 election, to be determined by the number <strong>of</strong> electors voting for gov-<br />

42 ernor thereat, submit to said voters the question whether hard surfac-<br />

43 ing shall be done on the primary road system, or any portion there<strong>of</strong>,<br />

44 in said county. Said petition shall be in writing, giving the name and<br />

45 residence <strong>of</strong> each signer thereto, and each sheet there<strong>of</strong> shall be veri-<br />

46 fied by a resident <strong>of</strong> the county. The board <strong>of</strong> supervisors shall be<br />

47 governed by the result <strong>of</strong> such election, and, if a majority <strong>of</strong> said<br />

48 voters voting thereon shall vote therefor, the board shall proceed forth-<br />

49 with with the work. Such election, however, shall not interfere with<br />

50 or affect work under construction, or under contract, or federal aid<br />

51 projects already approved at the time <strong>of</strong> the holding <strong>of</strong> said election.<br />

52 Notice <strong>of</strong> such election shall be given as provided in section<br />

53 twenty-nine hundred thirty-three <strong>of</strong> the compiled code, and the notice<br />

54 shall give the time said election shall be held and the form <strong>of</strong> the propo-<br />

55 sition submitted, and such proposition shall be contained in the ballot.<br />

56 Special elections shall be held in the same manner as general elections.
