CHAPTER 7.<br />

PRIMARY AND SECONDARY ROAD SYSTEMS.<br />

SECTION 2912. Primary road fund—apportionment.<br />

1 There is hereby created a fund which shall be known as the pri-<br />

2 mary road fund, which shall embrace :<br />

3 1. The federal-county-cooperative road fund as created by chap-<br />

4 ter six <strong>of</strong> this title.<br />

5 2. All additional and future federal aid road funds.<br />

6 3. All other funds derived from year to year by the state under<br />

7 acts regulatory <strong>of</strong> motor vehicles, except such portion <strong>of</strong> said motor<br />

8 vehicle fund as shall be necessary to maintain the federal aid engi-<br />

9 neering fund, and as may, by law, be retained in the state treasury as<br />

10 a maintenance fund for the state highway commission, or as a fund<br />

11 to cover administration <strong>of</strong> the motor vehicle department.<br />

12 The state highway commission shall apportion the primary road<br />

13 fund as herein provided. For the purposes <strong>of</strong> administration, the<br />

14 apportionment to any county may be made up partly -from the federal<br />

15 aid road allotments.<br />

16 Said primary road fund shall be apportioned to the respective<br />

17 counties in the ratio that the area <strong>of</strong> the county bears to the total<br />

18 area <strong>of</strong> the state, and shall be employed as herein provided, solelv in :<br />

19 1. The drainage, grading, surfacing and maintenance <strong>of</strong> the<br />

20 roads <strong>of</strong> the primary road system,<br />

21 2. The elimination or improvement <strong>of</strong> railroad crossings, and<br />

22 3. The construction and maintenance <strong>of</strong> bridges and culverts<br />

23 located on such primary road system,<br />

24 except as hereinafter provided.<br />

25 Nothing herein contained shall be construed as precluding the<br />

26 board <strong>of</strong> supervisors from paying for the construction and main-<br />

27 tenance <strong>of</strong> bridges and culverts on the primary road system, from the<br />

28 county bridge fund.<br />

29 The portion <strong>of</strong> said fund apportioned to each county as above<br />

30 provided, is hereby pledged to the completion <strong>of</strong> said primary system<br />

31 and is dedicated by the state to the county, to be used solely for the<br />

32 payment <strong>of</strong> the cost <strong>of</strong> such improvements or the maintenance there<strong>of</strong>,<br />

33 and for the redemption <strong>of</strong> any bonds issued therefor as herein pro-<br />

34 vided.<br />

SEC. 2913-al. Accounts by state auditor and treasurer.<br />

1 The account <strong>of</strong> the primary road fund kept by the state auditor<br />

2 and the state treasurer shall show the amount <strong>of</strong> the primary road<br />

3 fund with all credits thereto and disbursements therefrom, and shall<br />

4 deal with said fund as a single fund.<br />

SEC. 2914. Options authorized—election in re hard surfacing.<br />

1 Each county, acting through its board <strong>of</strong> supervisors, shall have<br />

2 three options in the expenditure <strong>of</strong> its allotments from the primary<br />

3 road fund:
