SEC. 2864-a2. Payment-'-appropriation.<br />

1 There is hereby appropriated out <strong>of</strong> any money in the state treas-<br />

2 ury not otherwise appropriated the funds necessary to pay the costs<br />

3 <strong>of</strong> any improvement provided for in this section to be paid when or as<br />

4 the improvement may be completed and accepted by the duly authorized<br />

5 authorities upon certificate <strong>of</strong> such authorities filed with the executive<br />

6 council who shall upon approval direct the auditor <strong>of</strong> state to issue<br />

7 warrant therefor.<br />

NOTE: The legislature apparently meant "the preceding section" and not<br />

"this section".<br />

CHAPTER 5.<br />

COUNTY ROAD, BRIDGE AND CULVERT SYSTEM.<br />

SECTION 2888. Gravel and material for road improvement—counties.<br />

1 The board <strong>of</strong> supervisors <strong>of</strong> any county is hereby authorized and<br />

2 empowered within the limits <strong>of</strong> such county and without the limits<br />

3 <strong>of</strong> any city or town, to procure, purchase or condemn, enter upon and<br />

4 take any lands for the purpose <strong>of</strong> obtaining gravel or other suitable<br />

5 material with which to improve the roads and highways <strong>of</strong> such county<br />

6 including a sufficient roadway to such land by the most reasonable<br />

7 route, and to pay for the same, one-half out <strong>of</strong> the primary road funds<br />

8 and one-half out <strong>of</strong> the county road funds, and it shall be the duty <strong>of</strong><br />

9 the board <strong>of</strong> supervisors <strong>of</strong> each county, where such material can be<br />

10 found within the county as herein provided, to procure, purchase or<br />

11 condemn such tracts so that no part <strong>of</strong> the county shall be more than<br />

12 six miles distant from land where such material can be obtained for<br />

13 highway purposes; provided that the board <strong>of</strong> supervisors shall not<br />

14 be required to purchase such land, but may procure the road material<br />

15 at any place within or without the county when the combined cost <strong>of</strong><br />

16 obtaining and hauling the same is not greater than the cost would be<br />

17 by condemnation proceedings under this section.<br />

SEC. 2894. Appropriations for county bridges—limitations.<br />

1 The board <strong>of</strong> supervisors <strong>of</strong> any county may appropriate for the<br />

2 construction <strong>of</strong> any one bridge within the limits <strong>of</strong> such county a sum<br />

3 not to exceed fifty thousand dollars and may appropriate for the con-<br />

4 struction <strong>of</strong> any one bridge, on the line between such county and<br />

5 another county <strong>of</strong> this state or between such county and another state,<br />

6 a sum not to exceed twenty-five thousand dollars.<br />

7 The term "bridge" as used in this section shall be held to include<br />

8 substructure, superstructure and approaches.<br />
