TITLE XL<br />

HIGHWAYS.<br />

CHAPTER 1.<br />

ESTABLISHMENT, ALTERATION AND VACATION OF HIGHWAYS.<br />

SECTION 2841. Laying out public highways—fees.<br />

1 The following fees shall be paid persons engaged in laying out<br />

2 and changing roads :<br />

3 1. Commissioners, such sum as shall be fixed by the board <strong>of</strong> super-<br />

4 visors, not to exceed three dollars for each day, together with ten cents<br />

5 per mile for the distance traveled in going to and returning from the<br />

6 location <strong>of</strong> the road under consideration.<br />

7 2. Surveyor, for each day, four dollars.<br />

8 3. Chain carriers, markers, and other assistants, for each day,<br />

9 one dollar and fifty cents.<br />

10 If the road extends into more than one county, such expenses<br />

11 when so adjudged shall be paid by the several counties in proportion<br />

12 to the length <strong>of</strong> time occupied on the road in each county.<br />

CHAPTER 4.<br />

STATE ROADS.<br />

SECTION 2863. Improving or paving roads adjoining state lands.<br />

[Repealed by 39 G. A., ch. 207, § 3.]<br />

SEC. 2864. Cost—appropriation.<br />

[This and the preceding section repealed by 39 G. A., ch. 207, §<br />

3, and the two following sections enacted in lieu there<strong>of</strong>.]<br />

SEC. 2864-al. Cost <strong>of</strong> improving highways adjoining state lands.<br />

1 Whenever any city, town or county is improving by draining, oil-<br />

2 ing, paving or otherwise hard surfacing any street or road which<br />

3 extends through any property owned by the state, and under control <strong>of</strong><br />

4 the board <strong>of</strong> education or state board <strong>of</strong> control, the said property shall<br />

5 be and is hereby made subject to the cost <strong>of</strong> the improvement through<br />

6 said property. Whenever the state has property under control <strong>of</strong><br />

7 either <strong>of</strong> the above boards abutting on one side <strong>of</strong> said street or road,
