§§ 2649-2649-a2. SCHOOLHOUSES AND SCHOOLHOUSE SITES. • Tit. X, Gh. 29.<br />

3 thereon <strong>of</strong> schoolhouses, and the convenient use there<strong>of</strong>, but not to<br />

4 exceed two acres exclusive <strong>of</strong> public highway, except in a city, town<br />

5 or village or cities under special charters it may include two blocks<br />

6 or area equal thereto exclusive <strong>of</strong> the street or highway as the case<br />

7 may be, for any one site, and may also take and hold such additional<br />

8 real estate, not exceeding five acres, as may be required for school<br />

9 playground or other purposes for each such site or districts consoli-<br />

10 dated under the provisions <strong>of</strong> chapter nineteen <strong>of</strong> this title, may take<br />

11 and hold not to exceed ten acres, for any one site, unless such addi-<br />

12 tional ground may be acquired by donation, which site must be upon<br />

13 some public road already established or procured by the board <strong>of</strong><br />

14 directors, and shall, except in cities,, towns or villages, be at least thirty<br />

15 rods from the residence <strong>of</strong> any owner who objects to its being placed<br />

16 nearer, and not in any public park.<br />

17 The directors in any independent district whose territory is com-<br />

18 posed wholly or in part <strong>of</strong> territory occupied by any city <strong>of</strong> the first<br />

19 and second class, city under the manager plan, or city under special<br />

20 charter may, at their regular meeting in July, or at a special meeting<br />

21 called for that purpose, between the time designated for such regular<br />

22 meeting and the third Monday in August, certify an amount not ex-<br />

23 ceeding four mills to the board <strong>of</strong> supervisors, and they shall levy the<br />

24 amount so certified, and the tax so levied shall be placed in the school-<br />

25 house fund and used only for the purchase <strong>of</strong> sites in and for said<br />

26 school district. Anything contained in section twenty-five hundred<br />

27 thirty-seven <strong>of</strong> the compiled code to the contrary notwithstanding.<br />

NOTE: This section in the compiled code refers to "section twenty-live hundred<br />

twenty-four". This reference has been stricken out and in lieu there<strong>of</strong> has<br />

been inserted "chapter nineteen <strong>of</strong> this title". This change was necessary because<br />

section 2524 was repealed by 39 G. A., ch. 175 and some forty sections enacted in<br />

lieu there<strong>of</strong>.<br />

SBC. 2649. Reversion.<br />

[Repealed by 39 G. A., ch. 183, §§ 1 and 3, and the three following<br />

sections enacted in lieu there<strong>of</strong>.]<br />

SEC. 2649-al. Reversion <strong>of</strong> schoolhouse site from nonuser.<br />

1 Any real estate owned by a school corporation, situated wholly<br />

2 outside <strong>of</strong> a city or town, and not adjacent thereto, and heret<strong>of</strong>ore used<br />

3 as a schoolhouse site, and which, for a period <strong>of</strong> two years continuously<br />

4 has not been used for any school purpose, shall revert to the then owner<br />

5 <strong>of</strong> the tract from which the same was taken, provided that said owner<br />

6 <strong>of</strong> the tract last aforesaid shall, within the time hereinafter prescribed,<br />

7 pay the value there<strong>of</strong> to such school corporation.<br />

SEC. 2649-a2. Appraisement <strong>of</strong> site—notice—public sale.<br />

1 In case the school corporation and said owner <strong>of</strong> the tract from<br />

2 which such school site was taken, do not agree as to the value <strong>of</strong> such<br />

3 site, the county superintendent <strong>of</strong> the county in which the greater part<br />

4 <strong>of</strong> such school corporation is situated, shall on the written application
