49 school from the district where such child resides than was entitled to<br />

50 attend under the county high school apportionment, then and in that<br />

51 case the school corporation where such child resides shall be entitled<br />

52 to be reimbursed from the county high school funds for the tuition so<br />

53 paid, not exceeding in the aggregate an amount equal to the taxes<br />

54 contributed by such district to said county high school funds for the<br />

55 tax year preceding, fair and equitable credit being given to the county<br />

56 high school fund for pupils actually attending said county high school<br />

57 during said school year from the district where said child resides.<br />

58 The county superintendent shall, on being applied to for such purpose,<br />

59 determine in writing the amount due such corporation from the county<br />

60 high school fund, and furnish such corporation with a copy <strong>of</strong> such<br />

61 finding. Within twenty days thereafter such corporation may appeal<br />

62 to the district court from such finding by serving written notice on<br />

63 the county superintendent <strong>of</strong> the taking <strong>of</strong> such appeal. On the serv-<br />

64 ice <strong>of</strong> said notice the county superintendent shall file a copy <strong>of</strong> his<br />

65 finding in the <strong>of</strong>fice <strong>of</strong> the clerk <strong>of</strong> the district court and the clerk shall<br />

66 docket the cause without fee. The matter shall be tried on appeal as<br />

67 in equity and without formal pleading. The decision <strong>of</strong> the district<br />

68 court shall be final. The treasurer shall, upon the filing with him <strong>of</strong><br />

69 any final decision, immediately transfer from the county high school<br />

70 funds to the credit <strong>of</strong> the corporation entitled to the same the amount<br />

71 directed to be transferred.<br />

INSTRUCTION OF DEAF.<br />

SECTION 2630. <strong>State</strong> aid.<br />

1 To any school corporation providing such instruction and com-<br />

2 plying with all <strong>of</strong> the provisions <strong>of</strong> this chapter there shall be granted<br />

3 and paid as hereinafter provided state aid in an amount to be com-<br />

4 puted at twenty dollars for each month that each child not more than<br />

5 ten years <strong>of</strong> age is instructed under the provisions <strong>of</strong> this chapter. No<br />

6 child more than twelve years <strong>of</strong> age shall be admitted to such instruc-<br />

7 tion.<br />
