SEC. 2365-a3. Secretary—records—certification.<br />

1 Said board shall elect one <strong>of</strong> its members secretary, who shall<br />

2 keep a record, in a book provided for that purpose, <strong>of</strong> all the proceed-<br />

3 ings <strong>of</strong> said board and certify a copy there<strong>of</strong> forthwith to the clerk<br />

4 <strong>of</strong> the district court <strong>of</strong> the county <strong>of</strong> the legal residence <strong>of</strong> the person<br />

5 against whom said proceedings were had. Said clerk <strong>of</strong> the district'<br />

6 court shall file and record said proceedings in the records <strong>of</strong> his <strong>of</strong>fice<br />

7 the same as if said proceedings had been before the commissioners <strong>of</strong><br />

8 insanity <strong>of</strong> said county.<br />

SEC. 2365-a4. Appeal—procedure—custody <strong>of</strong> patient.<br />

1 Any person found to be insane under the provisions herein author-<br />

2 ized may appeal from such finding to the district court <strong>of</strong> the county<br />

3 <strong>of</strong> the legal residence <strong>of</strong> such person. Said appeal and proceedings<br />

4 thereon shall be the same as if said finding appealed from had been<br />

5 made by the commissioners <strong>of</strong> insanity <strong>of</strong> said county ; except that a<br />

6 copy <strong>of</strong> the notice <strong>of</strong> appeal served, or to be served, upon the clerk<br />

7 <strong>of</strong> said district court shall be served on a member <strong>of</strong> the board <strong>of</strong><br />

8 commissioners <strong>of</strong> insanity hereby created, and if, at the time the copy<br />

9 <strong>of</strong> said notice <strong>of</strong> appeal is served on a member <strong>of</strong> said board, the<br />

10 patient is still in the actual custody <strong>of</strong> said board and not en route<br />

11 to a hospital for the insane, the said board hereby created shall cause<br />

12 said patient to be conducted, by its appointee or appointees, to the<br />

13 county <strong>of</strong> the legal residence <strong>of</strong> said patient in which said appeal was<br />

14 taken and deliver to the custody <strong>of</strong> the sheriff <strong>of</strong> said county, and<br />

15 thereafter the said patient shall be cared for and disposed <strong>of</strong> as if the<br />

16 proceedings appealed from had been had by the commissioners <strong>of</strong><br />

17 insanity <strong>of</strong> said county.<br />

SEC. 2365-a5. Jurisdiction <strong>of</strong> board after appeal.<br />

1 In the case <strong>of</strong> an appeal as herein provided, the jurisdiction <strong>of</strong><br />

2 the board <strong>of</strong> commissioners hereby created shall immediately cease,<br />

3 except as herein otherwise specially provided.<br />

SEC. S365-a6. Accompanying patients from hospital—payment.<br />

1 Whenever the board hereby created shall designate any person,<br />

2 or persons, to accompany any patient from said state psychopathic<br />

3 hospital to any state hospital for the insane, or to the county <strong>of</strong> the<br />

4 legal residence <strong>of</strong> the patient, the pay <strong>of</strong> such person, or persons, for<br />

5 performing such duty shall not exceed three dollars per day for the<br />

6 time thus necessarily employed, and the actual, reasonable and neces-<br />

7 sary expenses incurred in accompanying said patient and in returning<br />

8 home therefrom. Said per diem and expenses shall be itemized and<br />

9 verified and presented and allowed in connection with the bills for<br />

10 maintenance as hereinafter provided; provided, however, that if the<br />

11 party accompanying said patient is a parent or other relative, or an
