CHAPTER 13-A.<br />

PERMITTING OR CONTRIBUTING TO CHILD DELINQUENCY.<br />

SECTION 2113-al. Contributory delinquency defined.<br />

1 It shall be unlawful for any person to encourage any child under<br />

2 the age <strong>of</strong> sixteen years, to commit any act <strong>of</strong> delinquency as defined<br />

3 and specified in section twenty hundred eighty-nine <strong>of</strong> the compiled<br />

4 code ; or for any person to send or cause to be sent any such child to or<br />

5 permit any such child to enter or remain in any house <strong>of</strong> prostitution,<br />

6 or any place where intoxicating liquors are sold contrary to law, or<br />

7 any policy shop, or any pool room or gambling place, knowing them<br />

8 to be such ; or to knowingly encourage, contribute, or in any way cause<br />

9 any such child to violate any law <strong>of</strong> this state or the ordinances <strong>of</strong> any<br />

10 city in this state ; or to knowingly permit, contribute to or encourage,<br />

11 or cause any such child to be guilty <strong>of</strong> any vicious or immoral conduct.<br />

SEC. 2113-a2. Trial—procedure—right <strong>of</strong> appeal.<br />

1 Any person so <strong>of</strong>fending shall be guilty <strong>of</strong> a misdemeanor and may<br />

2 be tried for such <strong>of</strong>fense either in the juvenile court, or in any justice,<br />

3 superior or municipal court having jurisdiction therein, and upon con-<br />

4 viction shall be punished by fine or imprisonment or both.<br />

5 All trials <strong>of</strong> persons charged with contributing to the delinquency<br />

6 <strong>of</strong> a child shall be conducted in accordance with the rules in the<br />

7 municipal, superior or justice <strong>of</strong> the peace courts <strong>of</strong> the state <strong>of</strong> <strong>Iowa</strong>,<br />

8 while exercising criminal jurisdiction, and any person convicted shall<br />

9 have the same right <strong>of</strong> appeal as provided for appeals from such courts<br />

10 in such cases.<br />

11 • If in any proceeding in any juvenile court it shall appear that<br />

12 any person may have committed an indictable misdemeanor or felony<br />

13 that caused or contributed to the delinquency <strong>of</strong> such child, the judge<br />

14 <strong>of</strong> said juvenile court may have such person brought before him upon<br />

15 proper warrant; and if upon preliminary examination it shall appear<br />

16 that such person is probably guilty <strong>of</strong> the <strong>of</strong>fense charged, he shall<br />

17 be bound over to the grand jury <strong>of</strong> such county and placed under such<br />

18 reasonable bond to appear before the district court <strong>of</strong> said county as<br />

19 the judge <strong>of</strong> the juvenile court may prescribe.<br />

SEC. 2113-a3. Penalty—suspension <strong>of</strong> sentence—jury trial.<br />

1 Any person who shall be convicted <strong>of</strong> violating any <strong>of</strong> the pro-<br />

2 visions <strong>of</strong> this chapter, may be fined in a sum not to exceed one hun-<br />

3 dred dollars or by imprisonment in the county jail for not to exceed<br />

4 thirty days, or punished by both such fine and imprisonment.
