SEC. 1816-a4. Foreclosure—notice.<br />

1 The holder <strong>of</strong> the lien herein provided for may enforce the same<br />

2 by placing in the hands <strong>of</strong> any constable an affidavit containing a<br />

3 description <strong>of</strong> the stallion or jack, and <strong>of</strong> the progeny and its dam<br />

4 together with the time and terms <strong>of</strong> service, and a statement that the<br />

5 service fee is due and unpaid, and thereupon such constable shall<br />

6 immediately take possession <strong>of</strong> the animal or animals upon which a<br />

7 lien is claimed and may sell the same for nonpayment <strong>of</strong> the service •<br />

8 fee upon giving the owner there<strong>of</strong> ten days' written notice, which<br />

9 notice shall contain a copy <strong>of</strong> the affidavit and a description <strong>of</strong> the<br />

10 animal or animals to be sold together with the date, hour and place<br />

11 <strong>of</strong> sale, a copy <strong>of</strong> which notice shall be posted, for ten days prior to<br />

12 the sale, in three public places in the township in which the sale is to<br />

13 take place. If the owner <strong>of</strong> the property to be sold resides in the<br />

14 county, such notice shall also be served upon him at least ten days<br />

15 prior to the sale, the notice to be served in the same manner as orig-<br />

16 inal notices are served.<br />

SEC. 1816-a5. Sale—application <strong>of</strong> proceeds.<br />

1 If payment <strong>of</strong> the service fee, and constable costs, be not made<br />

2 prior to the time <strong>of</strong> sale, as fixed in such notice, the constable may<br />

3 sell property so held by him, or so much there<strong>of</strong> as may be necessary,<br />

4 at public auction to the highest bidder, and the proceeds shall be<br />

5 applied, first, to the payment <strong>of</strong> the costs, and second, in payment <strong>of</strong><br />

6 amount due for service fee. Any surplus arising from such sale shall<br />

7 be forthwith paid to the owner <strong>of</strong> the property sold.<br />
