4 hundred forty-one to seventeen hundred fifty, inclusive, <strong>of</strong> the com-<br />

5 piled code, and seventeen hundred thirty-three, seventeen hundred<br />

6 forty and seventeen hundred forty-two-a one <strong>of</strong> this supplement, is<br />

7 necessary for the public health and public welfare, and there is hereby<br />

8 appropriated out <strong>of</strong> any money in the state treasury, not otherwise<br />

9 appropriated, the sum <strong>of</strong> two hundred fifty thousand dollars annually.<br />

CHAPTER 15.<br />

INFECTIOUS AND CONTAGIOUS DISEASES AMONG ANIMALS.<br />

SECTION 1740. Examination for tuberculosis—destruction—indemnity.<br />

1 Owners <strong>of</strong> herds who desire to have their herds examined and<br />

2 tested with a view to detecting the presence <strong>of</strong> tuberculosis, and with<br />

3 a further view <strong>of</strong> freeing their herds from such disease, may apply<br />

4 to the commission for testing and examination. A blank for such appli-<br />

5 cation shall be furnished by the commission and shall include such an<br />

6 agreement on the part <strong>of</strong> the person making the said application that<br />

7 he will conform to and abide by the rules and regulations laid down<br />

8 by said commission and follow the instructions <strong>of</strong> said commission<br />

9 designated to prevent the reinfection <strong>of</strong> the herd and to suppress the<br />

10 disease or prevent the spread there<strong>of</strong>. Upon receiving such applica-<br />

11 tion, or if herds or animals are examined on the commission's own<br />

12 motion, the commission shall, as soon as practicable, cause such test<br />

13 or an examination to be made.<br />

14 The commission <strong>of</strong> animal health in passing upon applications<br />

15 shall first consider and give prior action to all applicants for the testing<br />

16 <strong>of</strong> dairy herds from which milk and milk products are sold, or <strong>of</strong>fered<br />

17 for sale in liquid or condensed form for human consumption in cities<br />

18 and incorporated towns.<br />

19 If, after such an examination, tubercular animals are found<br />

20 therein, the said commission shall have authority to order such dis-<br />

21 position <strong>of</strong> them as it considers most desirable and economical. Before<br />

22 being tested, such animals shall be appraised at their cash value for<br />

23 breeding, dairy or beef purposes by a representative <strong>of</strong> the commis-<br />

24 sion, or a representative <strong>of</strong> the United <strong>State</strong>s bureau <strong>of</strong> animal indus-<br />

25 try, or both together, with the owner. If these can not agree as to<br />

26 the amount <strong>of</strong> the appraisal, there shall be appointed three competent<br />

27 and disinterested men, one appointed by the commission, one by the<br />

28 owner, and the third by the first two, to appraise such animals, which<br />

29 appraisal shall be final.<br />

30 The expense <strong>of</strong> such appraisal shall be borne by the state. In the<br />

31 case <strong>of</strong> pure-bred cattle, the pedigree shall be proved by certificate <strong>of</strong><br />

32 registry from the herd books where registered. If it is deemed advis-<br />

33 able to slaughter an animal reacting to the tuberculin test, the owner<br />

34 shall be paid from the funds <strong>of</strong> the state treasury not otherwise appro-<br />

35 priated, a sum equal to one-third <strong>of</strong> the difference between the pro-<br />

36 ceeds from the sale <strong>of</strong> the salvage, which the owner receives, and the<br />

37 appraised breeding value <strong>of</strong> the animal, provided the state does not
