18 the authority <strong>of</strong> the society, but it shall have sole and exclusive control<br />

19 over and management there<strong>of</strong>.<br />

SEC. 1636-a9. Fraudulent entries <strong>of</strong> horses.<br />

1 No person, partnership, company or corporation shall knowingly<br />

2 enter or cause to be entered any horse <strong>of</strong> any age or sex under an<br />

3 assumed name, or out <strong>of</strong> its proper class, to compete for any purse,<br />

4 prize, premium, stake or sweepstake <strong>of</strong>fered or given by any agricul-<br />

5 tural or other society, association, person or persons in the state, or<br />

6 drive any such horse under an assumed name, or out <strong>of</strong> its proper class,<br />

7 where such prize, purse, premium, stake or sweepstake is to be decided<br />

8 by a contest <strong>of</strong> speed.<br />

SEC. 1636-alO. Violations—penalty.<br />

1 Any person convicted <strong>of</strong> a violation <strong>of</strong> the preceding section shall<br />

2 be imprisoned in the penitentiary for a period <strong>of</strong> not more than three<br />

3 years, or in the county jail for not mo.re than one year, and be fined in<br />

4 a sum not exceeding one thousand dollars.<br />

SEC. 1636-all. Entry under changed name.<br />

1 The name <strong>of</strong> any horse for the purpose <strong>of</strong> entry for competition<br />

2 in any contest <strong>of</strong> speed, shall not be changed after having once con-<br />

3 tested for a prize, purse, premium, stake or sweepstake, except as<br />

4 provided by the code <strong>of</strong> printed rules <strong>of</strong> the society or association under<br />

5 which the contest is advertised to be conducted, unless the former name<br />

6 is given.<br />

SEC. 1636-al2. Class determined.<br />

1 The class to which a horse belongs for the purpose <strong>of</strong> an entry in<br />

2 any contest <strong>of</strong> speed, as provided by the printed rules <strong>of</strong> the society or<br />

3 association under which such contest is to be made, shall be determined<br />

4 by the public record <strong>of</strong> said horse in any such former contest.<br />

SEC. 1637. County aid to county or district fairs—tax authorized.<br />

1 When a district or county agricultural society or fair shall have<br />

2 procured in fee simple, land for fair grounds, not less than ten acres<br />

3 in extent, or shall hold and occupy such amount <strong>of</strong> land by virtue <strong>of</strong><br />

4 a lease, and own and have thereon buildings and improvements worth<br />

5 not less than two thousand dollars, the board <strong>of</strong> supervisors <strong>of</strong> the<br />

6 county wherein such agricultural society or fair is located, may appro-<br />

7 priate and pay to it a sum not exceeding one hundred dollars for every<br />

8 thousand inhabitants in the county, to be expended by it in fitting up<br />

9 or purchasing such fair grounds, but for no other purpose, but the<br />

10 aggregate amount so appropriated shall not exceed one thousand dol-<br />

11 lars to any one society or fair in any one year.
