WEIGHTS AND MEASURES.<br />

SECTION 1572. Standards <strong>of</strong> weight. No change made<br />

2 shall be derived and ascertained, shall be the standard weights desig- mPiied code.<br />

3 nated in this chapter. The hundredweight consists <strong>of</strong> one hundred<br />

4 avoirdupois pounds, and twenty hundredweight are a ton. When-<br />

5 ever, hereafter, in this chapter, the word "pound" is used, it shall<br />

6 mean the avoirdupois pound unless otherwise distinctly specified.<br />

SEC. 1586. Automatic weighing or measuring device—license tag<br />

and fee.<br />

1 It shall be unlawful for any person, firm or corporation by himself,<br />

2 or as the <strong>of</strong>ficer, servant, agent, or employee <strong>of</strong> any person, firm or<br />

3 corporation to operate or use or display for use any scale or scales,<br />

4 known as money in the slot or automatic scale or scales or any weighing<br />

5 device, apparatus, or machine, which is used or intended for use to<br />

6 determine the weight <strong>of</strong> any person or persons, where compensation<br />

7 is derived, or any public or custom scale for which a fee is charged or<br />

8 accepted for weighing, or any gasoline pump or meter, unless said scale<br />

9 or device, or gasoline pump or, meter, is licensed by the commissioner.<br />

10 Upon payment <strong>of</strong> the license fee <strong>of</strong> three dollars, the commissioner<br />

11 shall issue a metal license "tag bearing the words "Licensed by the<br />

12 Dairy and Food Commissioner, <strong>State</strong> <strong>of</strong> <strong>Iowa</strong>, No. —, .", each tag to<br />

13 be numbered consecutively and bear the year for which license is valid.<br />

14 The tag shall be displayed prominently on the front <strong>of</strong> the weigh-<br />

15 ing device or gasoline pump or meter and the defacing or wrongful<br />

16 removal <strong>of</strong> such a tag shall be deemed a misdemeanor.<br />

17 Absence <strong>of</strong> the tag shall be prima facie evidence that the weigh-<br />

18 ing device or gasoline pump or -meter is being operated contrary to<br />

19 law.<br />

20 No license shall be issued until the annual fee <strong>of</strong> three dollars is<br />

21 paid to the commissioner for each scale or weighing device, or gasoline<br />

22 pump or meter, operated or used.<br />

23 Any person desiring to secure said license shall make application<br />

24 therefor upon blanks to be furnished by the commissioner. The com-<br />

25 missioner may withhold or revoke any license for cause.<br />

26 All licenses issued under this section shall expire on December<br />

27 thirty-first <strong>of</strong> each year, except in the case <strong>of</strong> gasoline pumps and<br />

28 meters the license shall become due on the first day <strong>of</strong> July <strong>of</strong> each<br />

29 year. All license and inspection fees collected under this section shall<br />

30 be paid into the state treasury by the commissioner.<br />

31 Products weighed upon any scale bearing inspection card, issued<br />

32 by the dairy and food commission, shall not be required to be re-<br />

33 weighed by any ordinance <strong>of</strong> any city or town or city under special<br />

34 charter or under the commission form <strong>of</strong> government nor shall their<br />

35 sale, at the weights so ascertained, and because, there<strong>of</strong>, be, by such<br />

36 ordinance, prohibited or restricted.<br />
