SEC. 1532-al4. Duty <strong>of</strong> attorney general.<br />

1 It shall be the duty <strong>of</strong> the attorney general to prosecute or cause<br />

2 to be prosecuted, all persons, firms or corporations violating the pro-<br />

3 visions <strong>of</strong> this chapter as provided in the next succeeding section, and<br />

4 for that purpose may require any county attorney to appear on behalf<br />

5 <strong>of</strong> the state.<br />

SEC. 1532-al5. Violations—penalty.<br />

1 Any person, firm or corporation violating any <strong>of</strong> the provisions <strong>of</strong><br />

2 this chapter, except those contained in the three last preceding sec-<br />

3 tions, or in any manner interfering with the commissioner or his<br />

4 agents in the discharge <strong>of</strong> their duties shall be guilty <strong>of</strong> a misdemeanor<br />

5 and upon conviction there<strong>of</strong> shall be fined in a sum not less than one<br />

6 hundred dollars nor more than five hundred dollars.<br />

SEC. 1532-al6. Interpreting clause.<br />

1 The provisions <strong>of</strong> this chapter shall not be construed in any way<br />

2 to abridge or limit any remedy which a vendee may now have against<br />

3 the vendor for misrepresentation or breach <strong>of</strong> warranty.<br />

CHAPTER 12.<br />

TURPENTINE.<br />

SECTION 1564. Substitutes—how labeled.<br />

1 No person, firm or corporation shall expose for sale, sell, or take<br />

2 orders for sale and delivery within this state, any compound or mixture<br />

3 <strong>of</strong> oil <strong>of</strong> turpentine with other products, or any product which is in-<br />

4 tended to be used as a substitute for oil <strong>of</strong> turpentine unless it is ex-<br />

5 posed for sale and sold under the name, "substitute for oil <strong>of</strong> turpen-<br />

6 tine", and, if the word "turpentine" is used other than in the name,<br />

7 the true name <strong>of</strong> each and every ingredient <strong>of</strong> said product shall also<br />

8 appear, giving preference <strong>of</strong> order to the ingredients present in the<br />

9 greater proportion, but all letters used in naming the ingredients shall<br />

10 be <strong>of</strong> the same size and color, using the style <strong>of</strong> type as hereinafter<br />

11 specified. Each tank car, tank, barrel, keg, can, jug or vessel, both<br />

12 wholesale and retail, also all storage receptacles containing said prod-<br />

13 uct, shall be distinctly and durably marked in a conspicuous place,<br />

14 using the English language and kind <strong>of</strong> type as hereinafter specified,<br />

15 giving the name under which it is sold, the names <strong>of</strong> ingredients when<br />

16 required and the name and place <strong>of</strong> business <strong>of</strong> the manufacturer or<br />

17 jobber there<strong>of</strong>, in continuous list, with no intervening matter <strong>of</strong> any<br />

18 kind, using ordinary bold-faced capital letters not less than five-line<br />

19 pica in size, and there shall be such a contrast between the color <strong>of</strong><br />

20 the type and the background <strong>of</strong> the label as to render the same easily<br />

21 and plainly legible.<br />
