PURE FOODS. § 1478.<br />

67 in the place <strong>of</strong> [ice] cream, is hereby declared "Imitation Ice Cream".<br />

68 No person, firm or corporation shall manufacture, have in his posses-<br />

69 sion, <strong>of</strong>fer to sell, or sell, solicit or take orders for delivery or ship any<br />

70 such imitation evaporated milk or imitation ice cream, except in the<br />

71 manner and subject to the regulations provided in this section.<br />

72 Imitation evaporated milk and imitation ice cream may be manu-<br />

73 factured, kept in possession, <strong>of</strong>fered for sale, or sold, if each can, tub.<br />

74 box, or other package in which same is kept, <strong>of</strong>fered for sale or shipped<br />

75 shall have plainly branded on the side or top there<strong>of</strong> in the English<br />

76 language in a durable manner, the words "Imitation Evaporated Milk"<br />

77 or "Imitation Ice Cream" as the case may be, the letters <strong>of</strong> the words<br />

78 to be not less than one inch in height and one-half inch in width ; pro-<br />

79 vided, however, that on packages containing less than twenty ounces<br />

80 net <strong>of</strong> imitation evaporated milk the words "Imitation Evaporated<br />

81 Milk" may appear plainly printed on the principal label <strong>of</strong> the package<br />

82 in type not less than one-fourth inch in height and one-eighth inch in<br />

83 width.<br />

84 Imitation evaporated milk and imitation ice cream may be kept,<br />

85 used or served only in case the proprietor or person in charge <strong>of</strong> the<br />

86 place in which such imitation evaporated milk or imitation ice cream<br />

87 is used, or served, shall display and keep constantly posted a card<br />

88 opposite each table, counter, or other places where the guests or others<br />

89 are served with the same, which card shall be white, at least ten by<br />

90 fourteen inches iïï size and the words "Imitation Evaporated Milk<br />

91 Used Here" or "Imitation Ice Cream Used Here", as the case may be,<br />

92 printed in black roman letters not less than three inches in height and<br />

93 two inches in width and no other words or figures shall be printed<br />

94 thereon; provided, however, that this provision shall not apply to a<br />

95 private residence <strong>of</strong> a person serving his family or guests.<br />

96 Nothing in this section or in section fourteen hundred forty-four<br />

97 <strong>of</strong> the compiled code shall be construed to require the labeling <strong>of</strong> nut<br />

98 ice cream or ice cream flavored with chocolate or cocoa, "Imitation Ice<br />

99 Cream".<br />

1 For the purposes <strong>of</strong> this chapter, the following standards are<br />

2 hereby established :<br />

3 FLAVORING EXTRACTS.<br />

4 1. Flavoring extract. A flavoring-extract is a solution in ethyl<br />

5 alcohol <strong>of</strong> proper strength <strong>of</strong> the sapid and odorous principles derived<br />

6 from an aromatic plant, or parts <strong>of</strong> the plant, with or without its<br />

7 coloring matter, and conforms in name to the plant used in its prep-<br />

8 aration.<br />

9 2. Almond extract. Almond extract is the flavoring extract pre-<br />

10 pared from oil <strong>of</strong> bitter almonds, free from hydrocyanic acid, and con-<br />
