4 grain solid extract <strong>of</strong> said cannabis indica, cannabis americana, or in-<br />

5 dian hemp or its equivalent <strong>of</strong> cannabis indica, cannabis americana or<br />

6 indian hemp in dhe ounce, or to liniments, ointments or other prepara-<br />

7 tions which are prepared for external use only; provided, that such<br />

8 remedies and preparations are sold, distributed, given away, dispensed<br />

9 or possessed as medicines and not for the purpose <strong>of</strong> evading the inten-<br />

10 tions and provisions <strong>of</strong> the preceding section.<br />

SEC. 1431. Penalty.<br />

1 Anyone found guilty <strong>of</strong> violating the provisions <strong>of</strong> sections four-<br />

2 teen hundred thirty and fourteen hundred thirty-a one <strong>of</strong> this supple-<br />

3 ment, for the first <strong>of</strong>fense, shall pay a fine <strong>of</strong> not less than twenty-five<br />

4 dollars and not more than one hundred dollars and cost <strong>of</strong> prosecution.<br />

5 For the second <strong>of</strong>fense, and each subsequent <strong>of</strong>fense, he shall pay on<br />

6 conviction there<strong>of</strong>, a fine <strong>of</strong> not less than one hundred dollars, and not<br />

7 more than three hundred dollars, or imprisonment in the county jail<br />

8 not to exceed three months. Any clerk, employee or agent, violating,<br />

9 or aiding in the violation <strong>of</strong> sections fourteen hundred thirty and four-<br />

10 teen hundred thirty-a one <strong>of</strong> this supplement shall be charged and con-<br />

11 victed as principal.<br />

SEC. 1432. Enforcement.<br />

1 Peace <strong>of</strong>ficers shall see that the provisions <strong>of</strong> sections fourteen<br />

2 hundred thirty, fourteen hundred thirty-a one, and fourteen hundred<br />

3 thirty-one <strong>of</strong> this supplement are faithfully executed within their re-<br />

4 spective jurisdictions, and when they are informed, or have reason to<br />

5 believe that sections fourteen hundred thirty, fourteen hundred<br />

6 thirty-a one, and fourteen hundred thirty-one <strong>of</strong> this supplement have<br />

7 been violated, and the pro<strong>of</strong> there<strong>of</strong> can be had, they shall file informa-<br />

8 tion to that effect against the <strong>of</strong>fending party before a magistrate,<br />

9 who thereupon shall proceed according to law. The county attorney<br />

10 shall prosecute violators <strong>of</strong> sections fourteen hundred thirty, fourteen<br />

11 hundred thirty-a one, and fourteen hundred thirty-one <strong>of</strong> this supple-<br />

12 ment.<br />
