SEC. 1306-a3. Regulations by board <strong>of</strong> health.<br />

1 It shall be the duty <strong>of</strong> the state board <strong>of</strong> health to make the<br />

2 necessary regulations for the enforcement <strong>of</strong> this chapter.<br />

SEC. 1306-a4. Penalty.<br />

1 Any person who shall wilfully violate any <strong>of</strong> the provisions <strong>of</strong><br />

2 this chapter shall be guilty <strong>of</strong> a misdemeanor, and upon conviction<br />

3 there<strong>of</strong> shall be punished by a fine <strong>of</strong> not more than five hundred<br />

4 dollars or by confinement in the county jail six months.<br />

CHAPTER 5.<br />

ANTITOXIN.<br />

SECTION 1310. Annual appropriation for expenses.<br />

1 For the purpose <strong>of</strong> carrying into effect the provisions <strong>of</strong> this<br />

2 chapter, and the payment <strong>of</strong> all expenses connected therewith, there<br />

3 is hereby appropriated out <strong>of</strong> any funds in the state treasury, not<br />

4 otherwise appropriated, the sum <strong>of</strong> two thousand dollars per annum,<br />

5 or so much there<strong>of</strong> as may be necessary to pay such expenses as may<br />

6 be incurred by the state board <strong>of</strong> health in establishing antitoxin sta-<br />

7 tions and providing for the distribution <strong>of</strong> <strong>Iowa</strong> state board <strong>of</strong> health<br />

8 antitoxin under the provisions <strong>of</strong> this chapter.<br />

CHAPTER 6.<br />

MEDICINE AND SURGERY.<br />

SECTION 1311. Practice <strong>of</strong> medicine defined.<br />

1 Any person shall be held as practicing medicine, surgery or<br />

2 obstetrics, or to be a physician, within the meaning <strong>of</strong> this chapter,<br />

3 who shall publicly pr<strong>of</strong>ess to be a physician, surgeon or obstetrician,<br />

4 and assume the duties, or who shall make a practice <strong>of</strong> prescribing or<br />

5 <strong>of</strong> prescribing and furnishing medicine for the sick; but it shall not<br />

6 be construed to prohibit students <strong>of</strong> medicine, surgery or obstetrics,<br />

7 who have had not less than two courses <strong>of</strong> lectures in a medical school<br />

8 <strong>of</strong> good standing, from prescribing under the supervision <strong>of</strong> precep-<br />

9 tors, or gratuitous service in case <strong>of</strong> emergency, nor to prevent the<br />

10 advertising, selling or prescribing natural mineral waters flowing from<br />

11 wells or springs, nor shall it apply to surgeons <strong>of</strong> the United <strong>State</strong>s<br />

12 army or navy, nor <strong>of</strong> the marine hospital service, nor to physicians
