40 ner as for other departments <strong>of</strong> the state. At the meeting held in July,<br />

41 a president shall be elected from the board <strong>of</strong> health for one year, and<br />

42 the board <strong>of</strong> appointment shall in July, nineteen hundred thirteen,<br />

43 name and appoint a secretary, as herein provided, not a member <strong>of</strong><br />

44 the board <strong>of</strong> health, who shall serve for a term <strong>of</strong> five years or until<br />

45 his successor is appointed, unless sooner removed by the board <strong>of</strong><br />

46 appointment for good cause; said secretary shall have charge <strong>of</strong> the<br />

47 <strong>of</strong>fice <strong>of</strong> the state board <strong>of</strong> health.<br />

48 When the board <strong>of</strong> health is not in session, the secretary shall be<br />

49 the executive <strong>of</strong>ficer there<strong>of</strong>, and commissioner <strong>of</strong> public health, and<br />

50 shall have full power and authority to execute and enforce all <strong>of</strong> the<br />

51 laws, rules and regulations <strong>of</strong> the board <strong>of</strong> health, pertaining to the<br />

52 health and life <strong>of</strong> the citizens <strong>of</strong> the state, to quarantine, to marriages,<br />

53 births and deaths, to sanitary investigations, and to all other matters<br />

54 subject to regulations and control by the board <strong>of</strong> health, the board <strong>of</strong><br />

55 medical examiners, and all <strong>of</strong> the various other departments that are<br />

56 now or may hereafter be provided by law, or by the rules and regula-<br />

57 tions <strong>of</strong> such boards or commissions as are authorized to make and<br />

58 adopt rules with reference thereto.<br />

SEC. 1263. Expenses <strong>of</strong> members.<br />

1 Each member <strong>of</strong> the board shall receive only actual traveling<br />

2 expenses incurred in the performance <strong>of</strong> his duties, said expenses to<br />

3 be itemized, verified, certified, audited, and a warrant drawn therefor.<br />

CHAPTER 4-A.<br />

PREVENTION OF BLINDNESS.<br />

SECTION 1306-al. Prophylactic treatment <strong>of</strong> eyes <strong>of</strong> newborn.<br />

1 Any physician or any person authorized by law to act as an<br />

2 obstetrician shall immediately upon the birth <strong>of</strong> an infant instill into<br />

3 the eyes <strong>of</strong> such newly born infant a prophylactic solution approved<br />

4 by the state board <strong>of</strong> health. Nothing in this chapter shall be con-<br />

5 strued to require medical treatment for the minor child <strong>of</strong> any person<br />

6 who is a member <strong>of</strong> a well recognized church or religious denomina-<br />

7 tion and whose religious convictions in accordance with the tenets or<br />

8 principles <strong>of</strong> his church or religious denomination are against medical<br />

9 treatment for disease.<br />

SEC. 1306-a2. Detection <strong>of</strong> infection—duty to treat or report.<br />

1 Any physician or any person authorized by law to act as an<br />

2 obstetrician in this state or any other person having the care <strong>of</strong> an<br />

3 infant, within six months after its birth who shall detect any inflam-<br />

4 mation, swelling or redness in the eyes <strong>of</strong> any such infant or any<br />

5 unnatural discharge therefrom, shall, if he be a physician, treat such<br />

6 child with the necessary prophylactic or, if he be other than a phy-
