(d) The provisions of OAR 411-340-0130(9) of this rule regarding<br />
sanctions that may be imposed on providers; and<br />
(e) The requirement to maintain a drug-free workplace.<br />
(9) SANCTIONS FOR INDEPENDENT PROVIDERS, PROVIDER<br />
ORGANIZATIONS, AND GENERAL BUSINESS PROVIDERS.<br />
(a) A sanction may be imposed on a provider when the brokerage<br />
determines that, at some point after the provider's initial qualification<br />
and authorization to provide supports purchased <strong>with</strong> support<br />
services funds, the provider has:<br />
(A) Been convicted of any crime that would have resulted in an<br />
unacceptable criminal records check upon hiring or<br />
authorization of service;<br />
(B) Been convicted of unlawfully manufacturing, distributing,<br />
prescribing, or dispensing a controlled substance;<br />
(C) Surrendered his or her professional license or had his or<br />
her professional license suspended, revoked, or otherwise<br />
limited;<br />
(D) Failed to safely and adequately provide the authorized<br />
services;<br />
(E) Had a founded report of child abuse or substantiated abuse;<br />
(F) Failed to cooperate <strong>with</strong> any Department or brokerage<br />
investigation or grant access to or furnish, as requested,<br />
records or documentation;<br />
(G) Billed excessive or fraudulent charges or been convicted of<br />
fraud;<br />
(H) Made false statement concerning conviction of crime or<br />
substantiation of abuse;<br />
(I) Falsified required documentation;<br />
