and durable and non-durable medical equipment not available under the<br />

State Medicaid Plan. Specialized medical equipment and supplies may not<br />

include items not of direct medical or remedial benefit to the individual.<br />

Specialized medical equipment and supplies must meet applicable<br />

standards of manufacture, design, and installation.<br />

(79) "Specialized <strong>Support</strong>s" mean treatment, training, consultation, or other<br />

unique services necessary to achieve outcomes in the Individual <strong>Support</strong><br />

Plan that are not available through State Medicaid Plan services or other<br />

support services listed in OAR 411-340-0130(6). Typical supports include<br />

the services of a behavior consultant, a licensed nurse, or a social or<br />

sexual consultant to:<br />

(a) Assess the needs of the individual and family, including<br />

environmental factors;<br />

(b) Develop a plan of support;<br />

(c) Train caregivers to implement the plan of support;<br />

(d) Monitor implementation of the plan of support; and<br />

(e) Revise the plan of support as needed.<br />

(80) "Speech and Language Therapy" means the services provided by a<br />

professional licensed under ORS 681.250 that are defined under the<br />

approved State Medicaid Plan, except that the amount, duration, and scope<br />

specified in the State Medicaid Plan do not apply.<br />

(81) "Substantiated" means an abuse investigation has been completed by<br />

the Department or the Department's designee and the preponderance of<br />

the evidence establishes the abuse occurred.<br />

(82) "<strong>Support</strong>" means assistance that individuals require, solely because of<br />

the affects of developmental disability, to maintain or increase<br />

independence, achieve community presence and participation, and<br />

improve productivity. <strong>Support</strong> is flexible and subject to change <strong>with</strong> time<br />

and circumstances.<br />
