6.4 Addressing gender as a barrier
Law is devised by human beings and cannot claim
perfection; equally, human beings can change it. This
does not imply any automatic legal bias in favour of
women and other marginalized groups. But it does
require acknowledging the very different experiences
of men and women regarding the same laws and legal
institutions. Institutions and attitudes may have to
recognize that with very unequal pre-existing conditions,
one may need elements of inequality to promote greater
equality. Once the equal value of all human beings is
accepted, a strong motivation for positive change can
be established. 122
