Ch 43, p.2 LAWYER TRUST ACCOUNT COMMISSION July 2009<br />

Client Security Commission, for purposes <strong>of</strong> carrying out duties under chapter 39 <strong>of</strong> the <strong>Iowa</strong> Court<br />

Rules.<br />

Rule 43.5 Compensation and expenses. Members <strong>of</strong> the commission shall serve without<br />

compensation but shall be paid their reasonable and necessary expenses incurred in the performance<br />

<strong>of</strong> their duties. All expenses <strong>of</strong> the operation <strong>of</strong> the commission shall be paid from funds the<br />

commission receives from lawyers’ interest-bearing trust accounts or income earned thereon.<br />

Rule 43.6 Disposition <strong>of</strong> funds upon dissolution. If the Lawyer Trust Account Commission is<br />

discontinued, any funds then on hand shall be transferred to its successor agency or organization<br />

qualifying under the Internal Revenue Code, if any, for distribution for the purposes specified under<br />

rule 43.2 or, if there is no successor, to the general fund <strong>of</strong> the state <strong>of</strong> <strong>Iowa</strong>.<br />

Rule 43.7 Supplemental rules. Subject to approval <strong>of</strong> the supreme court, the commission may make<br />

and adopt rules not inconsistent with these rules to govern the conduct <strong>of</strong> its business and performance<br />

<strong>of</strong> its duties.<br />

Rule 43.8 Applicability <strong>of</strong> <strong>Iowa</strong> Tort Claims Act. Claims against members <strong>of</strong> the commission and<br />

the director, assistant directors, and the staff <strong>of</strong> the <strong>of</strong>fice <strong>of</strong> pr<strong>of</strong>essional regulation are subject to the<br />

<strong>Iowa</strong> Tort Claims Act set forth in <strong>Iowa</strong> Code chapter 669.<br />
