Article 10 Origin<br />

The rule of origin has been derogated.<br />

Article 11 Performance guarantee<br />

The amount of the performance guarantee shall be equivalent to 5% (five %) of the<br />

maximum budget available for the framework contract including any amounts stipulated in<br />

addenda to the contract.<br />

Article 12 Insurance<br />

12.1 The contractor shall insure for replacement value of the goods until delivery.<br />

12.2 The contractor will be wholly responsible for the vehicles while they are on their premises and<br />

must be insured accordingly. Any damage incurred will be rectified by the contractor at his own<br />

cost.<br />

12.3 The contractor must ensure that all his staff carrying out the pick up, drop off and roads tests of<br />

the vehicles are fully insured and hold a valid driving license for the category of vehicle being<br />

driven.<br />

Article 15: <strong>Tender</strong> prices<br />

15.1. <strong>Tender</strong> prices for spare parts for lots 1 and 2 and 3 and 4.<br />

Purchase orders shall be placed on the basis of the prices referred to in the manufacturer’s price list in<br />

force on the date on which the purchase order are issued by the Contracting Authority, after application of<br />

the discount offered by the contactor in its financial offers.<br />

15.2. <strong>Tender</strong> prices for spare parts for lots 5 and 6.<br />

a) Lots 5 and 6: for spare parts NOT listed in the financial offer and in case vehicle’s Genuine<br />

Manufacturer’s parts and materials are available, the unit price will be the one referred to in the<br />

manufacturer’s price list in force at the time of the issuance of the purchase order.<br />

b) Lots 5 and 6: for the spare parts listed per vehicle, in the financial offer.<br />

After the second year of performance of the framework contract, should the Contracting Authority decide<br />

to extend this Framework Contract in accordance with Article 1.6 of the contract, for the spare parts listed<br />

per vehicle, in the financial offer; prices may be revised upwards or downwards, where such revision is<br />

requested by one of the contracting parties by registered letter. Purchase orders shall be placed on the<br />

basis of the prices in force on the date on which they are signed. Such prices shall not be subject to<br />

revision.<br />

This revision shall be determined by the trend in the harmonized consumer price index, HICP – all items<br />

of the Euro area, as published on Eurostat’s webpage (Euroindicators – HICP Predefined<br />

tables.http://epp.eurostat.ec.europa.eu/portal/page/portal/eurostat/home<br />

Revision shall be calculated in accordance with the following formula:<br />
