CONTENTS SPECIAL CONDITIONS These conditions amplify and supplement, if necessary, the General Conditions governing the contract. Unless the Special Conditions provide otherwise, those General Conditions remain fully applicable. The numbering of the Articles of the Special Conditions is not consecutive but follows the numbering of the Articles of the General Conditions. In exceptional cases, and with the authorisation of the competent Commission departments, other clauses may be introduced to cover specific situations. Article 2 Law applicable 2.1 EU law is the law which applies to the contract, complemented, where necessary, by Belgian law. 2.2 The language used shall be English. Article 4 Communications Any written communication relating to this Contract between the Contracting Authority and/or the Project Manager, on the one hand, and the Contractor on the other must state the Contract title and identification number, and must be sent by post, fax, e-mail or by hand. These measures must comply with the rules in the Communication and Visibility Manual for EU External Actions published by the European Commission: http://ec.europa.eu/europeaid/work/visibility/index_en.htm.
Article 10 Origin The rule of origin has been derogated. Article 11 Performance guarantee The amount of the performance guarantee shall be equivalent to 5% (five %) of the maximum budget available for the framework contract including any amounts stipulated in addenda to the contract. Article 12 Insurance 12.1 The contractor shall insure for replacement value of the goods until delivery. 12.2 The contractor will be wholly responsible for the vehicles while they are on their premises and must be insured accordingly. Any damage incurred will be rectified by the contractor at his own cost. 12.3 The contractor must ensure that all his staff carrying out the pick up, drop off and roads tests of the vehicles are fully insured and hold a valid driving license for the category of vehicle being driven. Article 15: Tender prices 15.1. Tender prices for spare parts for lots 1 and 2 and 3 and 4. Purchase orders shall be placed on the basis of the prices referred to in the manufacturer’s price list in force on the date on which the purchase order are issued by the Contracting Authority, after application of the discount offered by the contactor in its financial offers. 15.2. Tender prices for spare parts for lots 5 and 6. a) Lots 5 and 6: for spare parts NOT listed in the financial offer and in case vehicle’s Genuine Manufacturer’s parts and materials are available, the unit price will be the one referred to in the manufacturer’s price list in force at the time of the issuance of the purchase order. b) Lots 5 and 6: for the spare parts listed per vehicle, in the financial offer. After the second year of performance of the framework contract, should the Contracting Authority decide to extend this Framework Contract in accordance with Article 1.6 of the contract, for the spare parts listed per vehicle, in the financial offer; prices may be revised upwards or downwards, where such revision is requested by one of the contracting parties by registered letter. Purchase orders shall be placed on the basis of the prices in force on the date on which they are signed. Such prices shall not be subject to revision. This revision shall be determined by the trend in the harmonized consumer price index, HICP – all items of the Euro area, as published on Eurostat’s webpage (Euroindicators – HICP Predefined tables.http://epp.eurostat.ec.europa.eu/portal/page/portal/eurostat/home Revision shall be calculated in accordance with the following formula: Ir Pr = Po ( ──) Io Where : Pr = revised price.
