the time of the issuance of the purchase order and this shall be the sole remuneration owed by the<br />

Contracting Authority to the Contractor under the framework contract.<br />

3.1.2. Price for Spare parts for lots 5 and 6.<br />

3.1.2. a. For lots 5 and 6, concerning the spare parts listed per vehicle, the prices in the<br />

financial offer, shall be the sole remuneration owed by the Contracting Authority<br />

to the Contractor under the framework contract.<br />

3.1.2. b. For lots 5 and 6, concerning any other spare part than the ones referred to in<br />

article 3.1.2.a above i.e. concerning any spare parts NOT listed in the financial<br />

offer; in case vehicle’s Genuine Manufacturer’s parts and materials are available,<br />

the unit price will be the one referred to in the manufacturer’s price list in force<br />

at the time of the issuance of the purchase order. When vehicle’s Genuine<br />

Manufacturer’s parts and materials are not available, (e.g. for old dated vehicles),<br />

the contractor shall inform the project manager who may agree upon equivalent<br />

high standard parts as OEM (Original Equipment Manufacturer) to be installed,<br />

followed by a review and approval from EULEX Technical Experts.<br />

3.1.3. c. For lots 5 and 6, the unit prices of the spare parts listed per vehicle in the<br />

financial offer shall be firm and shall not be subject to revision for purchase<br />

orders placed during the two years of implementation of the framework contract.<br />

A price revision clause, in article 15 of the special conditions, may be applied<br />

after the second year, should the Contracting Authority decide to extend this<br />

Framework Contract in accordance with Article 1.6 of the contract.<br />

3.2. Price for Labour.<br />

3.2.1. For Labor the cost shall be determined by multiplying the unit price per working hour as<br />

specified in the financial offer with the amount of working hours specified on the invoice<br />

(as approved by the project manager).<br />

3.2.2. For lots 1 and 2 and 3 and 4 the number of hours of labor shall be calculated using the<br />

Manufacturer’s Flat Rate Schedule.<br />

3.2.3. For lot 5, when it is still available, the number of hours of labor shall be calculated using<br />

the Manufacturer’s Flat Rate Schedule. Wherever Manufacturer’s Flat Rate Schedule is<br />

not available, the Contracting Authority will request a quotation for repair work in<br />

writing. The quotation will be sent to EULEX Transport HQ for approval in advance of<br />

any repair taking place.<br />

3.2.4. For all lots, the price per hour of labour shall be firm and shall not be subject to revision<br />

for purchase orders placed during the two years of implementation of the framework<br />

contract. A price revision clause, in article 15 of the special conditions, may be applied<br />

after the second year, should the Contracting Authority decide to extend this Framework<br />

Contract in accordance with Article 1.6 of the contract.<br />

3.3. The sum of all payments shall not exceed the maximum budgetary sum of .<br />

3.4. Payments shall be made in accordance with the General and/or Special Conditions (Articles 26 to<br />

28). Payments shall be made to the bank account of the contractor, with identification<br />

number < ….>.
