The convergence and harmonisation of global labour and
employment laws – the future
• Will governments view labour, employment and discrimination laws
as a competitive factor and deregulate them (eg continental Europe)
or increase regulation (e.g. emerging countries) in order to be more
competitive?
• Will there be an upcoming supra-national legislator that will address a
more harmonised set of labour, employment and discrimination laws?
• Do multinationals want laws to be more harmonised? If so, do they
influence national legislators or set their own standards that are higher
than most national laws?
• Will laws of each region continue to be exported to other regions? (e.g.
EU privacy law, US discrimination law)
• Will US discrimination laws be adopted by other regions or will they
be “Europeanised”? What, if any, has been the impact of the US
presidential elections?
• Is there a certain set of laws that are more dominant in a region, but will
never be adopted by other regions of the world?
• Will the extraterritorial effect of laws further help harmonise labour,
employment and discrimination laws?
• How will a more global union movement impact harmonisation of labour
laws?
• What will be the role of multi-nationals?
International Bar Association
the global voice of the legal profession
The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international
legal practitioners, bar associations and law societies. The IBA influences the development of international law reform
and shapes the future of the legal profession throughout the world. It has a membership of more than 30,000
individual lawyers and more than 195 bar associations and law societies spanning all continents. It has considerable
expertise in providing assistance to the global legal community as well as being a source of distinguished legal
commentators for international news outlets.
Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division
– the IBA covers all practice areas and professional interests, providing members with access to leading experts
and up-to-date information. Through the various committees of the divisions, the IBA enables an interchange of
information and views among its members as to laws, practices and professional responsibilities relating to the
practice of business law around the globe.
Employment and Industrial Relations Law Committee
The aims of the committee are to develop and exchange knowledge of global, regional and local employment,
industrial relations and human resources law and practice. Members support each other through the provision of
innovative ideas and practical assistance on day to day issues.
Discrimination Law Committee
This committee is concerned with discrimination and gender equality issues which arise in the profession and under
the general law. A significant part of the committee’s work is concerned with discrimination and promotional issues
in the profession. For example, following the work of the committee, the IBA at its 1998 conference in Vancouver
adopted a formal resolution on non-discrimination in legal practice.
Both the Employment and Industrial Relations Law Committee and the Discrimination Law Committee publish a
newsletter twice each year with one publication coinciding with that year’s Annual IBA Conference. These newsletters
chronicle developments in the area of labour, employment, human resources and discrimination law. Articles are
written by members of the committees and other members of the IBA.
Membership in both committees is made up of private practitioners, academics and in-house counsel who specialise
in the substantive areas covered by the committees. Many of these professionals are also members of leading law
firms or corporations and have often had professional and practical experience in labour, employment, human
resources and discrimination law.
Hiring the Best
Qualified and Most
Talented Employees
Handbook on Global
Recruiting, Screening,
Testing and Interviewing
Criteria
edited by Salvador Del Rey &
Robert J. Mignin
More and more companies want to establish a uniform culture
among talented employees with common company values at all
levels of the organization at all operations throughout the world.
As companies expand their global operations, and as competition
within and across jurisdictions increases, companies want to
upgrade their workforce and hire the ‘very best’ and ‘most talented’
employees in each country where they have operations. Increasing
successful recruiting, interviewing and screening candidates – from
the lowest to the highest level within the organization – will reduce
turnover and other costs in the long run and increase profitability.
As companies expand their global operations, in-house and outside
counsel and H.R. representatives are more regularly being asked to
provide advice on the following issues:
■ What, if any, policies and procedures can a company adopt on a
global basis to hire the best employees?
■ What, if any, information can be requested of a candidate on an
employment application?
■ What, if any, questions can be asked of a candidate in an
interview?
■ What, if any, information needs to be shared with the candidate
about the company or about the job?
■ What, if any, pre-employment medical tests or exams or other
tests can be required of a candidate?
This handbook will provide both legal and practical answers to
these questions and discuss the delicate balance between
maintaining the privacy rights of employees with the business
interests of employers.
Redundancy Law in
Europe
edited by Maarten Van Kempen, Lisa
Patmore, Michael Ryley & Robert
von Steinau-Steinruck
The clear objective of European law in
relation to redundancy – defined in
the consolidated Collective
Redundancies Directive (98/59) as
‘dismissals effected by an employer
for one or more reasons not related to
the individual workers concerned’ – is
to promote industrial democracy. Thus, employees enjoy a
consultative role in the decision making process, and a level of
protection is provided to employees who are displaced. However,
specific legal criteria vary when it comes to restructuring
companies in different countries.
This book provides an overview of the relevant legislation
regarding redundancy schemes in each of the 27 EU Member
States, as well as Russia and Switzerland. Following an
introductory chapter describing the European directive regarding
mass redundancies, 29 country reports written by one or more
experienced employment lawyers from the respective country
offer overviews of relevant national legislation and case law
regarding timing, information and consultation, risks, and costs, as
well as practical legal guidance.
The individual reports cover how each jurisdiction deals with such
practical matters as the following:
■ freedom of management to organise and to reorganise
businesses;
■ enhancement of employee rights;
■ voluntary redundancy and voluntary early retirement
programmes;
■ circumstances where an employer is proposing to effect a
change of terms and conditions of employment;
■ the ‘ten percent rule’ model (comparing the number of
redundancies proposed to the total workforce) versus the
‘aggregate’ model (which focuses on the total number of
redundancies to be declared);
■ definition of ‘establishment’ for the purpose of applying the
consultation threshold;
■ exceptions (e.g., fixed term contracts, contracts which are task
related and where the task has been completed, public
administrative bodies, establishments governed by public law,
and the crews of sea-going vessels);
■ details of local law provisions concerning employee
representatives – local Works Councils, Comités d’Entreprise,
trade unions, or groups specifically elected for the purpose;
■ what must be covered in the consultation agenda;
■ obligation on the part of the employer to make all relevant
information available – e.g., reasons, number of categories of
workers to be made redundant, number and categories of
workers normally employed, period over which redundancies
are to be effected, selection criteria, and payment; and
■ notification to the relevant ‘competent public authority’ of
the impending redundancies.
This book will be enormously helpful to all who deal professionally
with employment law in one or more countries in Europe. Legal
counsel as well as HR directors will find it of great value in
numerous situations that arise constantly in the day-to-day
conduct of business.
