2.5 Register of incidents
The Taranaki Regional Council operates and maintains a register of all complaints or
reported and discovered excursions from acceptable limits and practices, including
non-compliance with consents, which may damage the environment. The register
(‘unauthorised incident register’) includes events where the company concerned has
itself notified the Council. The register contains details of any investigation and
corrective action taken.
Incidents may be alleged to be associated with a particular site. If there is an issue of
legal liability, the Council must be able to prove by investigation that the identified
company is indeed the source of the incident (or that the allegation cannot be
proven).
In the 2006-2007 year, there were 5 incidents recorded by the Council that were
associated with Taranaki Abattoirs. All of these incidents related to odours emitted
outside the site boundary, 1 of which was found to be objectionable or offensive and
therefore did not comply with special condition 3 of consent 4055. This consent
condition requires that at no time shall the consent holder cause or allow an odour at
or past the legal boundary of the consent holder’s site that in the opinion of an
enforcement officer of the Taranaki Regional Council is noxious or offensive or
objectionable. During the investigation of another odour complaint, it was
discovered that non-condensable gases were vented directly to air. This was a breach
of special condition 17(a) of the same consent.
During this monitoring period, no abatement notices were issued. However, during
this monitoring period, the Company was invited to explain the circumstances
relating to one of the reported breaches. An explanation was received, but was not
sufficient for the Council to withdraw enforcement action. Consequently an
infringement notice with $1,000 fine was issued.
