Comment: Many commenters emp<strong>has</strong>ized that we must<br />

implement the 1.1 percent update using the current 2008 CF<br />

as the base rate. Some requested that we include<br />

explanations of the calculations used to implement the<br />

1.1 percent conversion factor update and how we changed the<br />

application of 5-Year Review BN. Many commenters requested<br />

that we provide examples showing how these changes affect<br />

different categories of services.<br />

Response: Per the MIPPA, the 1.1 percent physician<br />

update is applied to the CY 2008 CF. Later in this<br />

section, we explain the calculations used for the CY 2009<br />

CF, including how we implemented both the 1.1 percent<br />

update and the change in the application of 5-Year Review<br />

BN.<br />

For the impact of these changes by specialty, see the<br />

Regulatory Impact Analysis in section XVI. of this final<br />

rule with comment period. In that section, we also include<br />

the overall impact of this final rule with comment period<br />

on selected procedures.<br />

C. Preliminary Estimate of the SGR for 2009<br />

Our preliminary estimate of the CY 2009 SGR is<br />
