under section 332(a)(1)(A) of the Public Health Service Act<br />

(42 U.S.C. 254e(a)(1)(A)); in a county that is not included<br />

in a Metropolitan Statistical Area; or in an entity that<br />

participates in a Federal telemedicine demonstration<br />

project that <strong>has</strong> <strong>been</strong> <strong>approved</strong> by (or receives funding<br />

from) the Secretary of Health and Human Services as of<br />

December 31, 2000. Previously, the statute described the<br />

following originating sites: the office of a physician or<br />

practitioner; a critical access hospital (as defined in<br />

section 1861(mm)(1) of the Act); a rural health clinic (as<br />

defined in section 1861(aa)(2) of the Act); a Federally<br />

qualified health center (as defined in section 1861(aa)(4)<br />

of the Act); and a hospital (as defined in section 1861(e)<br />

of the Act).<br />

Section 149 of the MIPPA amended section 1834 of the<br />

Act to add certain entities as originating sites for<br />

payment of telehealth services. As explained further<br />

below, MIPPA also amended section 1888(e)(2)(A)(ii) of the<br />

Act to exclude telehealth services furnished under section<br />

1834(m)(4)(C)(ii)(VII) from the consolidated billing<br />

provisions of the skilled nursing facility prospective<br />

payment system (SNF PPS).<br />

With respect to a telehealth service, subject to<br />

section 1833(a)(1)(U) of the Act, we pay a facility fee to<br />
