December 31, 2006, shall be treated as a rural area for<br />

purposes of making payments under the ambulance fee<br />

schedule for air ambulance services furnished during the<br />

period July 1, 2008 through December 31, 2009.<br />

Accordingly, for areas that were designated rural on<br />

December 31, 2006, and were subsequently redesignated as<br />

urban, we have re-established the “rural” indicator on the<br />

zip code file for air ambulance services effective<br />

July 1, 2008. We are revising §414.610 to add a new<br />

paragraph (h) to conform the regulations to this statutory<br />

requirement. <strong>This</strong> statutory requirement is<br />

self-implementing. A plain reading of the statute requires<br />

only a ministerial application of a rural indicator, and<br />

does not require any substantive exercise of discretion on<br />

the part of the Secretary.<br />

M. Section 149: Adding Certain Entities as Originating<br />

Sites for Payment of Telehealth Services<br />

Section 1834(m)(4)(C) of the Act defines a telehealth<br />

“originating site” to mean only those sites described in<br />

the statute at which an eligible telehealth individual is<br />

located at the time the service is furnished via a<br />

telecommunications system. The statute requires<br />

originating sites to be located in an area that is<br />

designated as a rural health professional shortage area<br />
