including our implementation of the new MIPPA amendments as<br />

they pertain to the 2009 PQRI, is discussed in detail in<br />

section II.O1. of this final rule with comment period.<br />

<strong>This</strong> final rule with comment period does not address nor<br />

does it attempt to implement any of the new MIPPA<br />

amendments as they pertain to the PQRI in 2010 and beyond.<br />

The new MIPPA amendments as they pertain to the PQRI in<br />

2010 and beyond will be addressed through future notice and<br />

comment rulemaking.<br />

Section 131(b)(1) of the MIPPA amends section<br />

1848(k)(2) of the Act to add new paragraph (C), which<br />

provides that for the purposes of reporting quality<br />

measures for covered professional services furnished during<br />

2010 and subsequent years for the PQRI, the quality<br />

measures (including electronic prescribing measures) shall<br />

be such measures selected by the Secretary from measures<br />

that have <strong>been</strong> endorsed by the entity with a contract with<br />

the Secretary under subsection 1890(a) as added by the<br />

MIPPA. Section 1848(k)(2)(C) of the Act also provides that<br />

for the 2010 and future years of the PQRI, in the case of a<br />

specified area or medical topic determined appropriate by<br />

the Secretary for which a feasible and practical measure<br />

<strong>has</strong> not <strong>been</strong> endorsed by the entity with a contract under<br />
