during 2009; and (3) who received an e-prescribing<br />

incentive payment for covered professional services<br />

furnished January 1, 2009 through December 31, 2009.<br />

Since the PQRI and the E-Prescribing Incentive Program<br />

are two separate incentive programs, it is feasible for an<br />

eligible professional who participated in both incentive<br />

programs to be listed both as an individual eligible<br />

professional who satisfactorily <strong>submitted</strong> data on quality<br />

measures for the PQRI and a successful electronic<br />

prescriber if he or she met the criteria for both incentive<br />

programs.<br />

d. Summary of Comments and Responses<br />

Although the MIPPA was not enacted until after<br />

publication of the CY 2009 PFS proposed rule, we received<br />

some comments related to this new incentive program that<br />

was authorized by the MIPPA. A summary of these comments<br />

and our responses is below.<br />

Comment: We received a few comments about the PQRI<br />

Measure #125. These commenters suggested that prior to<br />

implementation of this quality measure in the e-prescribing<br />

incentive program, the quality measure and our design of<br />

the e-prescribing incentive program should go through a<br />

public comment process. One commenter indicated support<br />

for the e-prescribing incentive but noted that implementing<br />
