percent of the professional’s total Part B allowed charges<br />

for the incentive to apply. <strong>This</strong> limitation is designed to<br />

target the electronic prescribing incentive payments to<br />

physicians or other eligible professionals who have the<br />

opportunity to prescribe a statutorily determined<br />

sufficient amount of prescriptions and not provide<br />

incentive payments of 2.0 percent of allowed charges in a<br />

year to those physicians who do not have the opportunity to<br />

prescribe a threshold amount of prescriptions. However,<br />

this limitation does not affect the ability to report the<br />

measure, but rather we will apply it in the final<br />

determination as to whether an incentive is earned. See<br />

the discussion below.<br />

As initially required under section 1848(k)(2)(A)(ii)<br />

of the Act, and further established through rulemaking and<br />

under section 1848(m)(2)(B) of the Act, we may modify the<br />

codes making up the denominator of the electronic<br />

prescribing measure. We have considered whether to expand<br />

the scope of the denominator codes to professional services<br />

outside the professional office and outpatient setting for<br />

2009, such as professional services furnished in hospitals<br />

or skilled nursing facilities. Although we retain the<br />

authority to update technical specifications of the measure<br />
