If they are found to meet the requirements, the EHR vendors will be included in the data submission testing. These processes will have firm timelines that vendors must meet. Failure to meet any of these deadlines will be a basis for not continuing to consider the EHR vendor for qualification to submit data to the CMS quality data warehouse. The number of self-nominated vendors will determine the timeframe needed to complete the testing and qualification process. However, it is expected that this process will conclude by mid-summer 2009. The measures and reporting mechanism for the 2010 PQRI will be the subject of future notice and comment rulemaking. Overview and Summary Section 1848(k)(2)(B)(ii) of the Act requires CMS to publish in the Federal Register by no later than August 15, 2008, a proposed set of quality measures that the Secretary determines would be appropriate for eligible professionals to use to submit data in 2009. In addition, section 1848(k)(2)(B)(iii) of the Act requires CMS to publish in the Federal Register by no later than November 15, 2008, the final set of quality measures that would be appropriate for eligible professionals to use to submit data in 2009. As discussed in the CY 2009 PFS proposed rule (73 FR 38565), in examining the statutory requirements of section 1848(k)(2)(B)(i) of the Act, as amended by the MMSEA, we believe that the requirement that measures be endorsed or adopted by a consensus organization applies to each measure that would be included in the measure set for submitting quality data and/or quality measures results and numerator and denominator data on the quality measures on covered professional services furnished during 2009. Likewise, the requirement for measures to have been developed using a consensus-based process (as identified by the Secretary) applies to each measure.
